1.1 A bill for an act 1.2 relating to human services; establishing a consumer-directed community supports 1.3 budget exception for persons with certain diagnoses; amending Minnesota Statutes 1.4 2024, section 256B.4911, by adding a subdivision. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 256B.4911, is amended by adding a subdivision 1.7to read: 1.8 Subd. 4a.Budget exception for persons with developmental disabilities and type 1 1.9diabetes.(a) The commissioner must establish a consumer-directed community supports 1.10budget exception process for persons with both developmental disabilities and type 1 diabetes 1.11in the home and community-based services waivers under sections 256B.092 and 256B.49. 1.12This budget exception process must be available for any person who has both of the following 1.13diagnoses documented in the person's assessment under section 256B.0911: 1.14 (1) a developmental disability; and 1.15 (2) type 1 diabetes. 1.16 (b) The amount of the exception must be an annualized amount equal to nine hours per 1.17day at the current rate for home care nursing provided by a registered nurse under the 1.18identified waiver program at the time of application for the budget exception under this 1.19subdivision. 1.20 EFFECTIVE DATE.This section is effective January 1, 2026, or upon federal approval, 1.21whichever is later.
