55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 342.01, subdivision 5, is amended to read:​
77 1.7 Subd. 5.Advertisement."Advertisement" means any written or oral statement,​
88 1.8illustration, or depiction that is intended to promote sales of cannabis flower, cannabis​
99 1.9products, lower-potency hemp edibles, hemp-derived consumer products, or sales at a​
1010 1.10specific cannabis business or hemp business and includes any newspaper, radio, Internet​
1111 1.11and electronic media, or television promotion; the distribution of fliers and circulars; and​
1212 1.12the display of window and interior signs in a cannabis business. Advertisement does not​
1313 1.13include a fixed outdoor sign that meets the requirements in section 342.64, subdivision 2,​
1414 1.14paragraph (b).​
1515 1.15 Sec. 2. Minnesota Statutes 2024, section 342.64, subdivision 3, is amended to read:​
1616 1.16 Subd. 3.Audience under 21 years of age.Except as provided in subdivision 2, A​
1717 1.17cannabis business, hemp business, or other person shall not publish or cause to be published​
1818 1.18an advertisement for a cannabis business, a hemp business, cannabis flower, a cannabis​
1919 1.19product, a lower-potency hemp edible, or a hemp-derived consumer product in any print​
2020 1.20publication or on radio, television, or any other medium if 30 percent or more of the audience​
2121 1.21of that medium is reasonably expected to be individuals who are under 21 years of age, as​
2222 1.22determined by reliable, current audience composition data.​

3636 Subd. 2.Outdoor advertisements; cannabis business signs.(a) Except as provided in paragraph​
3737 (c), an outdoor advertisement of a cannabis business, a hemp business, cannabis flower, a cannabis​
3838 product, a lower-potency hemp edible, or a hemp-derived consumer product is prohibited.​
3939 (b) Cannabis businesses and hemp businesses may erect up to two fixed outdoor signs on the​
4040 exterior of the building or property of the cannabis business or hemp business.​
4141 (c) The prohibition under paragraph (a) does not apply to an outdoor advertisement for a hemp​
4242 business, or the goods or services the business offers, that is not related to the manufacture or sale​
4343 of lower-potency hemp edibles and does not include an image, description, or any reference to the​
4444 manufacture or sale of lower-potency hemp edibles.​
