                            1.1	A bill for an act​
1.2 relating to solid waste; requiring surety bond for tire collectors; amending​
1.3 Minnesota Statutes 2024, section 115A.902, by adding a subdivision.​
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.5 Section 1. Minnesota Statutes 2024, section 115A.902, is amended by adding a subdivision​
1.6to read:​
1.7 Subd. 1a.Bond requirement.Before a permit is issued or renewed, a tire collector that​
1.8is required to obtain a permit under subdivision 1 must have on file with the commissioner​
1.9a surety bond executed by a surety company authorized to do business in the state in the​
1.10sum of at least $150,000. The bond must be continuous in nature until canceled by the​
1.11surety. A surety must provide at least a 30-day notice in writing to the tire collector and to​
1.12the commissioner indicating the surety's intent to cancel the bond and the effective date of​
1.13the cancellation. The surety bond must be for the benefit of the citizens of the state and must​
1.14be conditioned upon the tire collector's willingness to comply with sections 115A.90 to​
1.15115A.914 and rules adopted thereunder. The surety's liability under this subdivision is​
1.16limited to the amount of the bond or the amount of the damages or moneys due, whichever​
1.17is less. This subdivision does not limit the amount of damages recoverable from a tire​
1.18collector to the amount of the surety bond. The bond must be made in a form prescribed by​
1.19the commissioner.​
