66 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
77 1.7 Section 1. Minnesota Statutes 2024, section 609.19, subdivision 2, is amended to read:​
88 1.8 Subd. 2.Unintentional murders.Whoever does either of the following is guilty of​
99 1.9unintentional murder in the second degree and may be sentenced to imprisonment for not​
1010 1.10more than 40 years:​
1111 1.11 (1) causes the death of a human being, without intent to effect the death of any person,​
1212 1.12while committing or attempting to commit a felony offense other than criminal sexual​
1313 1.13conduct in the first or second degree with force or violence or a drive-by shooting; or​
1414 1.14 (2) causes the death of a human being without intent to effect the death of any person,​
1515 1.15while intentionally inflicting or attempting to inflict bodily harm upon the victim, when the​
1616 1.16perpetrator is restrained under an order for protection and the victim is a person designated​
1717 1.17to receive protection under the order. As used in this clause, "order for protection" includes​
1818 1.18an order for protection issued under chapter 518B; a harassment restraining order issued​
1919 1.19under section 609.748; a court order setting conditions of pretrial release or conditions of​
2020 1.20a criminal sentence or juvenile court disposition; a restraining order issued in a marriage​
2121 1.21dissolution action; and any order issued by a court of another state or of, the United States,​
2222 1.22the District of Columbia, Tribal Lands, United States territories, Canada, or a Canadian​
2323 1.23province that is similar to any of these orders.​
