55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 171.06, subdivision 1, is amended to read:​
77 1.7 Subdivision 1.Application format and requirements.Every application for a Minnesota​
88 1.8identification card, including an enhanced identification card, or for a driver's license,​
99 1.9including an instruction permit, a provisional license, a noncompliant driver's license, a​
1010 1.10REAL ID driver's license, and an enhanced driver's license, must be made in a format​
1111 1.11approved by the department. Every application must be accompanied by payment of the​
1212 1.12proper fee. All applicants must sign the application and declare, under penalty of perjury,​
1313 1.13that the information and documentation presented in the application is true and correct. All​
1414 1.14applications requiring evidence of legal presence in the United States or United States​
1515 1.15citizenship must be signed in the presence of the person authorized to accept the application,​
1616 1.16or the signature on the application may be verified by a notary public. Every application​
1717 1.17must include the following statement: "Only citizens of the United States are eligible to​
1818 1.18vote. If you are not a citizen, you are not eligible to vote. Voting if you are not eligible to​
1919 1.19vote is a felony that is punishable by not more than five years imprisonment and a fine of​
2020 1.20not more than $10,000, or both. A felony conviction may lead to deportation in some​
2121 1.21instances."​

3131 The bill was read for the first time and referred to the Committee on Transportation Finance and Policy​ 2.1 Sec. 2. Minnesota Statutes 2024, section 171.06, subdivision 8, is amended to read:​
3232 2.2 Subd. 8.Noncompliant license or identification card; residence, lawful status.(a)​
3333 2.3A person who applies for a noncompliant driver's license or identification card:​
3434 2.4 (1) must declare the applicant's residence address in Minnesota; and​
3535 2.5 (2) is not required must be asked to demonstrate United States citizenship or lawful​
3636 2.6presence in the United States.​
3737 2.7 (b) The commissioner or driver's license agent must record whether United States​
3838 2.8citizenship or lawful presence in the United States was demonstrated and, if so, which​
3939 2.9documents were provided. Data collected pursuant to this paragraph must only be used for​
4040 2.10the purpose of improving the accuracy of voter registration records under section 171.12,​
4141 2.11subdivision 7a.​
4242 2.12 (b) (c) Minnesota Rules, part 7410.0410, or any successor rule, does not apply for a​
4343 2.13noncompliant driver's license or identification card.​
4444 2.14 (c) (d) Nothing in this section allows the commissioner to issue a commercial driver's​
4545 2.15license to an applicant who does not demonstrate proof of citizenship or immigration status​
4646 2.16if required by federal law.​
