| 7 | 7 | | 1.7 (a) To ensure compliance with the Minnesota Constitution, article XIV, sections 2, 5, |
|---|
| 8 | 8 | | 1.8and 6, commissioners of state agencies must not include in a biennial budget any expenditures |
|---|
| 9 | 9 | | 1.9from the trunk highway fund or the highway user tax distribution fund for a nonhighway |
|---|
| 10 | 10 | | 1.10purpose or for any purpose prohibited by section 161.045. |

| 11 | 11 | | 1.11 (b) No later than 45 days following the submission of the governor's biennial budget to |

| 12 | 12 | | 1.12the legislature under section 16A.11, the commissioner of management and budget and the |

| 13 | 13 | | 1.13attorney general must jointly submit a report to the chairs and ranking minority members |
|---|
| 14 | 14 | | 1.14of the legislative committees with jurisdiction over transportation policy and finance. The |
|---|
| 15 | 15 | | 1.15report must examine proposed appropriations from the trunk highway fund and the highway |
|---|
| 16 | 16 | | 1.16user tax distribution fund, explain the highway purpose of the proposed appropriations, |
|---|
| 17 | 17 | | 1.17determine if any proposed appropriation is for a nonhighway purpose, and, for nonhighway |
|---|
| 18 | 18 | | 1.18purposes, recommend the fund to be used. |

| 19 | 19 | | 1.19 (c) For the purposes of this section, an appropriation for a nonhighway purpose is any |
|---|
| 20 | 20 | | 1.20appropriation not for construction, improvement, or maintenance of highways or for any |
