| 5 | 5 | | 1.5 Section 1. Minnesota Statutes 2024, section 151.741, subdivision 2, is amended to read: |

| 6 | 6 | | 1.6 Subd. 2.Assessment of registration fee.(a) The board shall assess each manufacturer |

| 7 | 7 | | 1.7an annual registration fee of $100,000, except as provided in paragraph (b). The board shall |
|---|
| 8 | 8 | | 1.8notify each manufacturer of this requirement beginning November 1, 2024, and each |
|---|
| 9 | 9 | | 1.9November 1 thereafter. The commissioner of health shall provide technical assistance to |
|---|
| 10 | 10 | | 1.10the board using available data sources, including but not limited to data collected under |
|---|
| 11 | 11 | | 1.11section 62U.04. |

| 12 | 12 | | 1.12 (b) A manufacturer may request an exemption from the annual registration fee. The |
|---|
| 13 | 13 | | 1.13board shall exempt a manufacturer from the annual registration fee if the manufacturer can |

| 14 | 14 | | 1.14demonstrate to the board, in the form and manner specified by the board, that gross revenue |
|---|
| 15 | 15 | | 1.15total wholesale acquisition cost from sales of dispensing claims within or into Minnesota |
|---|
| 16 | 16 | | 1.16for prescription insulin produced by that manufacturer and sold or delivered within or into |
|---|
| 17 | 17 | | 1.17Minnesota was less than five percent of the total gross revenue wholesale acquisition cost |
|---|
| 18 | 18 | | 1.18from sales of prescription insulin produced by all manufacturers and sold or delivered within |
|---|
| 19 | 19 | | 1.19or into Minnesota dispensing claims of prescription insulin products by all manufacturers |
|---|
