2	2	1.2 relating to public safety; modifying the crime of fleeing a peace officer in a motor
3	3	1.3 vehicle to add a heightened penalty for fleeing in a culpably negligent manner;
4	4	1.4 amending Minnesota Statutes 2024, sections 171.174; 609.487, subdivision 5, by
5	5	1.5 adding a subdivision.
6	6	1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
7	7	1.7 Section 1. Minnesota Statutes 2024, section 171.174, is amended to read:
8	8	1.8 171.174 REVOCATION; FLEEING PEACE OFFICER OFFENSE.
9	9	1.9 The commissioner of public safety shall revoke the license of a person upon receipt of
10	10	1.10a certificate of conviction showing that the person has in a motor vehicle violated section
11	11	1.11609.487, subdivision 3, 3a, or 4, or an ordinance in conformity with those subdivisions. The
12	12	1.12commissioner shall revoke the license as follows:
13	13	1.13 (1) for the first offense under section 609.487, subdivision 3, for not less than one year;
14	14	1.14 (2) for the second offense or subsequent offenses under section 609.487, subdivision 3,
15	15	1.15for not less than three years;
16	16	1.16 (3) for an offense under section 609.487, subdivision 3a, for not less than four years;
17	17	1.17 (4) for an offense under section 609.487, subdivision 4, clause (a), for not less than ten
18	18	1.18years;
19	19	1.19 (4) (5) for an offense under section 609.487, subdivision 4, clause (b), for not less than
20	20	1.20seven years; and
21	21	1.21 (5) (6) for an offense under section 609.487, subdivision 4, clause (c), for not less than
22	22	1.22five years.

32	32	The bill was read for the first time and referred to the Committee on Public Safety Finance and Policy 2.1A limited license under section 171.30 may not be issued for one-half of the revocation
33	33	2.2period specified in clauses (1) to (5) (6) and after that period is over only upon and as
34	34	2.3recommended by the adjudicating court.
35	35	2.4 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to crimes
36	36	2.5committed on or after that date.
37	37	2.6 Sec. 2. Minnesota Statutes 2024, section 609.487, is amended by adding a subdivision to
38	38	2.7read:
39	39	2.8 Subd. 3a.Fleeing an officer; motor vehicle; culpable negligence.Whoever, by means
40	40	2.9of a motor vehicle, flees or attempts to flee a peace officer who is acting in the lawful
41	41	2.10discharge of an official duty, and the perpetrator knows or should reasonably know the same
42	42	2.11to be a peace officer, and who in the course of fleeing operates the vehicle in a culpably
43	43	2.12negligent manner whereby the perpetrator creates an unreasonable risk and consciously
44	44	2.13takes chances of causing death or great bodily harm to another, is guilty of a felony and
45	45	2.14may be sentenced to imprisonment for not more than four years or to payment of a fine of
46	46	2.15not more than $8,000, or both.
47	47	2.16 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to crimes
48	48	2.17committed on or after that date.
49	49	2.18 Sec. 3. Minnesota Statutes 2024, section 609.487, subdivision 5, is amended to read:
50	50	2.19 Subd. 5.Revocation; fleeing peace officer offense.When a person is convicted of
51	51	2.20operating a motor vehicle in violation of subdivision 3, 3a, or 4, or an ordinance in conformity
52	52	2.21with those subdivisions, the court shall notify the commissioner of public safety and order
53	53	2.22the commissioner to revoke the driver's license of the person.
54	54	2.23 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to crimes
55	55	2.24committed on or after that date.
