                            1.1	A bill for an act​
1.2 relating to human services; prohibiting the commissioner of human services from​
1.3 limiting currently available day services or special minimum wage rules or policies;​
1.4 amending Minnesota Statutes 2024, section 256B.4905, subdivision 5a.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. Minnesota Statutes 2024, section 256B.4905, subdivision 5a, is amended to​
1.7read:​
1.8 Subd. 5a.Employment first implementation for disability waiver services.(a) The​
1.9commissioner of human services shall ensure that:​
1.10 (1) the disability waivers under sections 256B.092 and 256B.49 support the presumption​
1.11that all working-age Minnesotans with disabilities can work and achieve competitive​
1.12integrated employment with appropriate services and supports, as needed; and​
1.13 (2) each waiver recipient of working age be offered, after an informed decision-making​
1.14process and during a person-centered planning process, the opportunity to work and earn a​
1.15competitive wage before being offered exclusively day services as defined in section​
1.16245D.03, subdivision 1, paragraph (c), clause (4), or successor provisions.​
1.17 (b) Notwithstanding any law to the contrary, the commissioner of human services must​
1.18not adopt any rule or implement any policy that:​
1.19 (1) eliminates, reduces, or limits availability of day services as defined in section 245D.03,​
1.20subdivision 1, paragraph (c), clause (4), or successor provisions; or​
1.21 (2) restricts a waiver recipient's ability to earn a special minimum wage under either a​
1.2214(c) certificate issued by the United States Department of Labor under United States Code,​
