                            1.1	A bill for an act​
1.2 relating to human rights; prohibiting discrimination based on disability status;​
1.3 amending Minnesota Statutes 2024, section 363A.19.​
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.5 Section 1. Minnesota Statutes 2024, section 363A.19, is amended to read:​
1.6 363A.19 DISCRIMINATION AGAINST PERSONS WITH DISABILITIES​
1.7PROHIBITED.​
1.8 Subdivision 1.Discrimination prohibited.(a) Notwithstanding any provision of law​
1.9to the contrary, no individual with a disability shall, due to the reasons of the disability, be​
1.10excluded from participation in or be denied the benefits of the services, programs, or activities​
1.11of a public or private entity that receives money from the state of Minnesota. An entity must​
1.12provide reasonable accommodations to an individual with a disability and must ensure no​
1.13individual with a disability is discriminated against by the entity.​
1.14 (b) For purposes of this section, "individual with a disability" or "person with a disability"​
1.15means an individual with a physical or mental condition that substantially limits one or​
1.16more major life activities, including caring for oneself, mobility, learning, seeing, hearing,​
1.17communicating, breathing, working, and social interaction.​
1.18 (c) For purposes of this section, "disability" and "unfair discriminatory practice" have​
1.19the meanings given in section 363A.03, subdivisions 12 and 48.​
1.20 Subd. 2.Service animals.(a) It is an unfair discriminatory practice for an owner,​
1.21operator, or manager of a hotel, restaurant, public conveyance, or other public place to​
1.22prohibit a person with a disability from taking a service animal into the public place or​

The bill was read for the first time and referred to the Committee on Judiciary Finance and Civil Law​ 2.1conveyance to aid persons with disabilities, and if the service animal is properly harnessed​
2.2or leashed so that the person with a disability may maintain control of the service animal.​
2.3 (b) No person shall require a person with a disability to make an extra payment or pay​
2.4an additional charge when taking a service animal into any of the public places referred to​
2.5in paragraph (a).​
2.6 (c) For purposes of this section, "service animal" means a service animal as defined by​
2.7the federal Americans with Disabilities Act, as amended.​
2.8 EFFECTIVE DATE.This section is effective the day following final enactment.​
2.9 Sec. 2. REVISOR INSTRUCTION.​
2.10 The revisor of statutes shall add an additional cross-reference to Minnesota Statutes,​
2.11section 363A.19, whenever the term "section 504 of the Rehabilitation Act" appears in​
2.12Minnesota Statutes when used in the context of the Rehabilitation Act of 1973, United States​
2.13Code Annotated, title 29, section 794. The revisor shall make any technical language,​
2.14grammatical, and other changes needed to carry out this instruction.​
