                            1.1	A bill for an act​
1.2 relating to commerce; removing a prohibition against certain ticket sales and​
1.3 advertisements; amending Minnesota Statutes 2024, section 325F.676, subdivision​

1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. Minnesota Statutes 2024, section 325F.676, subdivision 3, is amended to read:​
1.7 Subd. 3.Prohibitions.(a) A ticket reseller or online ticket marketplace must not:​
1.8 (1) sell or offer to sell more than one copy of the same ticket to a place of entertainment;​
1.9 (2) directly or indirectly employ another person to wait in line to purchase tickets for​
1.10the purpose of reselling the tickets if the practice is prohibited or if the place of entertainment​
1.11has posted a policy prohibiting the practice;​
1.12 (3) sell or offer to sell a ticket without first informing the person of the location of the​
1.13place of entertainment and the ticket's assigned seat, including but not limited to the seat​
1.14number, row, and section number of the seat; or​
1.15 (4) sell or offer to sell a ticket for which there is no assigned seat without first informing​
1.16the person of the general admission area to which the ticket corresponds; or.​
1.17 (5) advertise, offer for sale, or contract for the sale of a ticket before the ticket has been​
1.18made available to the public, including via presale, without first obtaining permission from​
1.19the place of entertainment and having actual or constructive possession of the ticket, unless​
1.20the ticket reseller owns the ticket pursuant to a season ticket package purchased by the ticket​
1.21reseller.​

The bill was read for the first time and referred to the Committee on Commerce Finance and Policy​ 2.1 (b) A person must not use or cause to be used an Internet domain name or subdomain​
2.2thereof in an operator, ticket reseller, or online ticket marketplace website's URL that contains​
2.3any of the following, unless acting on behalf of the place of entertainment, event, or person​
2.4scheduled to perform or appear at the event:​
2.5 (1) the name of a place of entertainment;​
2.6 (2) the name of an event, including the name of a person scheduled to perform or appear​
2.7at the event; or​
2.8 (3) a name substantially similar to those described in clause (1) or (2).​
2.9 (c) A person must not:​
2.10 (1) circumvent any portion of the process for purchasing a ticket on the Internet or for​
2.11admission to a place of entertainment, including but not limited to security or identity​
2.12validation measures or an access control system; or​
2.13 (2) disguise the identity of a purchaser for the purpose of purchasing a number of tickets​
2.14for admission to a place of entertainment that exceeds the maximum number of tickets​
2.15allowed for purchase by a person.​
2.16 (d) A person must not sell a ticket obtained in violation of paragraph (c) if the person:​
2.17 (1) participated in or had the ability to control the conduct committed in violation of​
2.18paragraph (c); or​
2.19 (2) knew that the ticket was acquired in violation of paragraph (c).​
2.20 (e) An operator, online ticket marketplace, or ticket reseller must not sell a ticket unless:​
2.21 (1) the ticket is in the possession or constructive possession of the operator, online ticket​
2.22marketplace, or ticket reseller; or​
2.23 (2) the operator, online ticket marketplace, or ticket reseller has a written contract with​
2.24the place of entertainment to obtain the ticket.​
2.25 (f) Pursuant to United States Code, title 15, section 45c, circumvention of a security​
2.26measure, access control system, or other technological control measure used by an online​
2.27ticket marketplace to enforce posted event ticket purchasing limits or to maintain the integrity​
2.28of posted online ticket purchasing order rules is prohibited.​
