44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. [462.3655] DATA CENTERS.​
66 1.6 Subdivision 1.Definitions.(a) For the purposes of this section, the following terms have​
77 1.7the meanings given.​
88 1.8 (b) "Enterprise data center" means a facility comprised of one or more buildings that​
99 1.9are located on a single parcel or on contiguous parcels that:​
1010 1.10 (1) in aggregate contains more than 800,000 square feet of space that house or support​
1111 1.11the operation of enterprise information technology equipment; and​
1212 1.12 (2) has a primary purpose of providing for the storage, management, or processing of​
1313 1.13digital data.​
1414 1.14 (c) "Enterprise information technology equipment" means computers and equipment​
1515 1.15supporting computing, networking, or data storage, including but not limited to cabling and​
1616 1.16racking systems; cooling systems, cooling towers, and other temperature control​
1717 1.17infrastructure; and power infrastructure for transformation, distribution, or management of​
1818 1.18electricity used for the maintenance and operation of a facility, including but not limited to​
1919 1.19exterior dedicated business-owned substations, backup power generation systems, battery​
2020 1.20systems, and related infrastructure.​
2121 1.21 (d) "Industrial district" means an area of land that a municipality has defined by law,​
2222 1.22rule, or ordinance to allow manufacturing facilities.​

3535 2.4or effect beyond the lot on which the use is located. Such uses include but are not limited​
3636 2.5to sawmills; refineries; commercial feedlots; acid; cement; explosives; flour, feed, and grain​
3737 2.6milling or storage; meatpacking and slaughter houses; coal or tar asphalt distillation;​
3838 2.7rendering of fat, grease, lard, or tallow; alcoholic beverages; poisons; exterminating agents;​
3939 2.8glue or size; lime; gypsum; plaster of paris; tanneries; automobile parts; paper and paper​
4040 2.9products; glass chemicals, crude oil, and petroleum products, including storage; electric​
4141 2.10power generation facilities; vinegar works; junkyard; auto reduction yard; foundry forge;​
4242 2.11casting metal products; rock, stone, and cement products; lumberyards; machine shops;​
4343 2.12products assembly; sheet metal shops; plastics; electronics; general nonalcoholic beverages;​
4444 2.13signs and displays; printing; publishing; fabricated metal parts; appliances; clothing; textiles;​
4545 2.14and used auto parts.​
4646 2.15 Subd. 2.Limitation on data center siting.(a) Except as provided in paragraph (b), a​
4747 2.16municipality must not allow the development of an enterprise data center in any zoning​
4848 2.17district.​
4949 2.18 (b) A municipality may allow an enterprise data center as a conditional use in an industrial​
5050 2.19district.​
5151 2.20 EFFECTIVE DATE; APPLICATION.This section is effective June 20, 2025, and​
5252 2.21applies to enterprise data centers constructed on or after that date.​
