| 5 | 5 | | 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

| 6 | 6 | | 1.6 Section 1. Minnesota Statutes 2024, section 295.52, subdivision 8, is amended to read: |

| 7 | 7 | | 1.7 Subd. 8.Contingent reduction in tax rate.(a) By December 1 of each year, beginning |

| 8 | 8 | | 1.8in 2011, the commissioner of management and budget shall must determine the projected |
|---|
| 9 | 9 | | 1.9balance in the health care access fund for the biennium. |
|---|
| 10 | 10 | | 1.10 (b) If the commissioner of management and budget determines that the projected balance |

| 11 | 11 | | 1.11in the health care access fund for the biennium reflects a ratio of revenues to expenditures |

| 12 | 12 | | 1.12and transfers greater than 125 percent, and if the actual cash balance in the fund is adequate, |

| 13 | 13 | | 1.13as determined by the commissioner of management and budget, the commissioner, in |
|---|
| 14 | 14 | | 1.14consultation with the commissioner of revenue, shall must reduce the tax rates levied under |
|---|
| 15 | 15 | | 1.15subdivisions 1, 1a, 2, 3, and 4, for the subsequent calendar year sufficient to reduce the |

| 16 | 16 | | 1.16structural balance in the fund. The rate may be reduced to the extent that the projected |
|---|
| 17 | 17 | | 1.17revenues for the biennium do not exceed 125 percent of expenditures and transfers. The |
|---|
| 18 | 18 | | 1.18new rate shall be rounded to the nearest one-tenth of one percent. The rate reduction under |
|---|
| 19 | 19 | | 1.19this paragraph expires at the end of each calendar year and is subject to an annual |
|---|
| 20 | 20 | | 1.20redetermination by the commissioner of management and budget. |
