1.2 relating to health insurance; prohibiting algorithm or artificial intelligence use

1.4 section 62A.59, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2024, section 62A.59, is amended by adding a subdivision
1.7to read:
1.8 Subd. 3.Algorithm and artificial intelligence use prohibited.A health carrier is
1.9prohibited from using an algorithm or artificial intelligence program when making a
1.10determination to approve or deny a prior authorization request.
1.11 EFFECTIVE DATE.This section is effective January 1, 2026, and applies to health
1.12plans offered, sold, issued, or renewed on or after that date.
