66 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
77 1.7 Section 1. Minnesota Statutes 2024, section 123B.595, subdivision 4, is amended to read:​
88 1.8 Subd. 4.Facilities plans.(a) To qualify for revenue under this section, a school district​
99 1.9or intermediate district, not including a charter school, must have a ten-year facility plan​
1010 1.10adopted by the school board and approved by the commissioner. The plan must include​
1111 1.11provisions for implementing a health and safety program that complies with health, safety,​
1212 1.12and environmental regulations and best practices, including indoor air quality management​
1313 1.13and remediation of lead hazards. The plan may include provisions for enhancing school​
1414 1.14safety through physical modifications to school facilities as described in subdivision 4a.​
1515 1.15For planning purposes, the plan must also address provisions for providing a gender-neutral​
1616 1.16single-user restroom at each school site.​
1717 1.17 (b) The district must annually update the plan, submit the plan to the commissioner for​
1818 1.18approval by July 31, and indicate whether the district will issue bonds to finance the plan​
1919 1.19or levy for the costs.​
2020 1.20 (c) For school districts issuing bonds to finance the plan, the plan must include a debt​
2121 1.21service schedule demonstrating that the debt service revenue required to pay the principal​
2222 1.22and interest on the bonds each year will not exceed the projected long-term facilities revenue​
2323 1.23for that year.​

3838 2.6may include remodeling and new construction for school security enhancements and​
3939 2.7equipment and facility modifications related to violence prevention and facility security.​
4040 2.8Projects authorized may be included in the plan until the projects are complete.​
4141 2.9 EFFECTIVE DATE.This section is effective for revenue in fiscal year 2026 and later.​
4242 2.10 Sec. 3. Minnesota Statutes 2024, section 123B.595, subdivision 10, is amended to read:​
4343 2.11 Subd. 10.Allowed uses for long-term facilities maintenance revenue.(a) A district​
4444 2.12may use revenue under this section for any of the following:​
4545 2.13 (1) deferred capital expenditures and maintenance projects necessary to prevent further​
4646 2.14erosion of facilities;​
4747 2.15 (2) increasing accessibility of school facilities;​
4848 2.16 (3) health and safety capital projects under section 123B.57;​
4949 2.17 (4) school safety facility enhancements authorized under subdivision 4a;​
5050 2.18 (5) remodeling or constructing a gender-neutral single-user restroom at each school site;​
5151 2.19or​
5252 2.20 (5) (6) by board resolution, to transfer money from the general fund reserve for long-term​
5353 2.21facilities maintenance to the debt redemption fund to pay the amounts needed to meet, when​
5454 2.22due, principal and interest on general obligation bonds issued under subdivision 5.​
5555 2.23 (b) A charter school may use revenue under this section for any purpose related to the​
5656 2.24school.​
5757 2.25 EFFECTIVE DATE.This section is effective for revenue in fiscal year 2026 and later.​
5858 2.26 Sec. 4. Minnesota Statutes 2024, section 123B.595, subdivision 11, is amended to read:​
5959 2.27 Subd. 11.Restrictions on long-term facilities maintenance revenue.Notwithstanding​
6060 2.28subdivision 10, long-term facilities maintenance revenue may not be used:​
6161 2​Sec. 4.​

6363 3.2of portable classrooms, except for the costs associated with constructing or remodeling​
6464 3.3existing facilities to include at least one gender-neutral single-user restroom authorized​
6565 3.4under subdivision 10;​
6666 3.5 (2) to finance a lease purchase agreement, installment purchase agreement, or other​
6767 3.6deferred payments agreement;​
6868 3.7 (3) for energy-efficiency projects under section 123B.65, for a building or property or​
6969 3.8part of a building or property used for postsecondary instruction or administration, or for a​
7070 3.9purpose unrelated to elementary and secondary education; or​
7171 3.10 (4) for violence prevention and facility security, ergonomics, or emergency​
7272 3.11communication devices.​
7373 3.12 EFFECTIVE DATE.This section is effective for revenue in fiscal year 2026 and later.​
