6	6	1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
7	7	1.7 Section 1. Minnesota Statutes 2024, section 123B.595, subdivision 4, is amended to read:
8	8	1.8 Subd. 4.Facilities plans.(a) To qualify for revenue under this section, a school district
9	9	1.9or intermediate district, not including a charter school, must have a ten-year facility plan
10	10	1.10adopted by the school board and approved by the commissioner. The plan must include
11	11	1.11provisions for implementing a health and safety program that complies with health, safety,
12	12	1.12and environmental regulations and best practices, including indoor air quality management
13	13	1.13and remediation of lead hazards. The plan may include provisions for enhancing school
14	14	1.14safety through physical modifications to school facilities as described in subdivision 4a.
15	15	1.15For planning purposes, the plan must also address provisions for providing a gender-neutral
16	16	1.16single-user restroom at each school site.
17	17	1.17 (b) The district must annually update the plan, submit the plan to the commissioner for
18	18	1.18approval by July 31, and indicate whether the district will issue bonds to finance the plan
19	19	1.19or levy for the costs.
20	20	1.20 (c) For school districts issuing bonds to finance the plan, the plan must include a debt
21	21	1.21service schedule demonstrating that the debt service revenue required to pay the principal
22	22	1.22and interest on the bonds each year will not exceed the projected long-term facilities revenue
23	23	1.23for that year.

34	34	2.2 Sec. 2. Minnesota Statutes 2024, section 123B.595, is amended by adding a subdivision
35	35	2.3to read:
36	36	2.4 Subd. 4a.School safety facility enhancements.A school district may include in its
37	37	2.5facilities plan a school safety facility enhancements plan. School safety enhancement projects
38	38	2.6may include remodeling and new construction for school security enhancements and
39	39	2.7equipment and facility modifications related to violence prevention and facility security.
40	40	2.8Projects authorized may be included in the plan until the projects are complete.
41	41	2.9 EFFECTIVE DATE.This section is effective for revenue in fiscal year 2026 and later.
42	42	2.10 Sec. 3. Minnesota Statutes 2024, section 123B.595, subdivision 10, is amended to read:
43	43	2.11 Subd. 10.Allowed uses for long-term facilities maintenance revenue.(a) A district
44	44	2.12may use revenue under this section for any of the following:
45	45	2.13 (1) deferred capital expenditures and maintenance projects necessary to prevent further
46	46	2.14erosion of facilities;
47	47	2.15 (2) increasing accessibility of school facilities;
48	48	2.16 (3) health and safety capital projects under section 123B.57;
49	49	2.17 (4) school safety facility enhancements authorized under subdivision 4a;
50	50	2.18 (5) remodeling or constructing a gender-neutral single-user restroom at each school site;
51	51	2.19or
52	52	2.20 (5) (6) by board resolution, to transfer money from the general fund reserve for long-term
53	53	2.21facilities maintenance to the debt redemption fund to pay the amounts needed to meet, when
54	54	2.22due, principal and interest on general obligation bonds issued under subdivision 5.
55	55	2.23 (b) A charter school may use revenue under this section for any purpose related to the
56	56	2.24school.
57	57	2.25 EFFECTIVE DATE.This section is effective for revenue in fiscal year 2026 and later.
58	58	2.26 Sec. 4. Minnesota Statutes 2024, section 123B.595, subdivision 11, is amended to read:
59	59	2.27 Subd. 11.Restrictions on long-term facilities maintenance revenue.Notwithstanding
60	60	2.28subdivision 10, long-term facilities maintenance revenue may not be used:
61	61	2Sec. 4.
62	62	REVISOR CR/AC 25-0277901/29/25 3.1 (1) for the construction of new facilities, remodeling of existing facilities, or the purchase
63	63	3.2of portable classrooms, except for the costs associated with constructing or remodeling
64	64	3.3existing facilities to include at least one gender-neutral single-user restroom authorized
65	65	3.4under subdivision 10;
66	66	3.5 (2) to finance a lease purchase agreement, installment purchase agreement, or other
67	67	3.6deferred payments agreement;
68	68	3.7 (3) for energy-efficiency projects under section 123B.65, for a building or property or
69	69	3.8part of a building or property used for postsecondary instruction or administration, or for a
70	70	3.9purpose unrelated to elementary and secondary education; or
71	71	3.10 (4) for violence prevention and facility security, ergonomics, or emergency
72	72	3.11communication devices.
73	73	3.12 EFFECTIVE DATE.This section is effective for revenue in fiscal year 2026 and later.
