                            1.1	A bill for an act​
1.2 relating to commerce; prohibiting a public adjuster from appearing as an advocate​
1.3 in any action or proceeding; amending Minnesota Statutes 2024, section 72B.135,​
1.4 subdivision 4.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. Minnesota Statutes 2024, section 72B.135, subdivision 4, is amended to read:​
1.7 Subd. 4.Prohibited practices.No public adjuster shall:​
1.8 (1) pay money or give anything of value to a person in consideration of a direct or indirect​
1.9referral of a client or potential client;​
1.10 (2) pay money or give anything of value to a person as an inducement to refer business​
1.11or clients;​
1.12 (3) rebate to a client a part of a fee specified in an employment contract;​
1.13 (4) initiate contact with a prospective client between the hours of 8 p.m. and 8 a.m.;​
1.14 (5) split the fee received or pay money to a person for services rendered to a client unless​
1.15the other person is also licensed as a public adjuster;​
1.16 (6) have an interest directly or indirectly in a construction firm, salvage firm, or appraisal​
1.17firm. "Firm" includes a corporation, partnership, association, or individual firm;​
1.18 (7) in connection with the transaction of business as a public adjuster, make a willful or​
1.19knowing misrepresentation of facts or advise a person on questions of law;​
1.20 (8) make willful or knowing false statements about an insurance company or its​
1.21employees, agents, or representatives;​

2.2employment contract with another public adjuster;​
2.3 (10) represent both an insurer and insured simultaneously; or​
2.4 (11) advance money to a client pending the settlement of a loss where the amount would​
2.5be included in a final settlement.; or​
2.6 (12) appear as an advocate or a person's representative in any action or proceeding before​
2.7an administrative tribunal, including an arbitration pursuant to section 65B.525.​
