66 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
77 1.7 Section 1. Minnesota Statutes 2024, section 473.39, subdivision 7, is amended to read:​
88 1.8 Subd. 7.Limitation on certain debt obligations.The council is prohibited from issuing​
99 1.9certificates of participation for light rail transit guideways secured in whole or in part by​
1010 1.10(1) a pledge of motor vehicle sales tax revenue received under sections 16A.88 and 297B.09,​
1111 1.11or (2) a pledge of any earnings from the council's investment of motor vehicle sales tax​
1212 1.12revenues.​
1313 1.13 EFFECTIVE DATE; APPLICATION.This section is effective July 1, 2025, and​
1414 1.14applies in the counties of Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, and Washington.​
1515 1.15 Sec. 2. [473.4487] COUNTY RESPONSIBILITY FOR GUIDEWAY FUNDING.​
1616 1.16 (a) Counties must fund guideways, as defined in section 473.4485, subdivision 1,​
1717 1.17paragraph (d), including current and future guideways pursuant to the requirements in this​
1818 1.18section.​
1919 1.19 (b) A host county or counties must fund:​
2020 1.20 (1) planning, design, engineering, construction, prerevenue operations, and other costs​
2121 1.21associated with guideway development that exceed federal, state, local government, or other​

3131 The bill was read for the first time and referred to the Committee on Transportation Finance and Policy​ 2.1funds dedicated to the guideway. This requirement pertains to all costs associated with​
3232 2.2guideway development, including associated costs not eligible for federal funding;​
3333 2.3 (2) operating costs of guideway services determined by the service operator to be​
3434 2.4necessary to meet reasonable standards for access, safety, and reliability and that exceed​
3535 2.5fare revenues and federal, state, local government, or other funds dedicated to the guideway;​
3636 2.6and​
3737 2.7 (3) capital maintenance, replacement, and modernization costs determined by the operator​
3838 2.8of guideway services to be necessary to meet reasonable standards for access, safety,​
3939 2.9reliability, and upkeep of the guideway and that exceed federal, state, local government, or​
4040 2.10other funds dedicated to the guideway.​
4141 2.11 (c) For purposes of this section, "host county or counties" means those counties where​
4242 2.12the guideway is located.​
4343 2.13 (d) The distribution of costs among host counties must be delineated through a​
4444 2.14proportional methodology agreed to by the host counties.​
4545 2.15 EFFECTIVE DATE; APPLICATION.This section is effective July 1, 2025, and​
4646 2.16applies in the counties of Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, and Washington.​
