44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. Minnesota Statutes 2024, section 148.56, subdivision 1, is amended to read:​
66 1.6 Subdivision 1.Optometry defined.(a) Any person shall be deemed to be practicing​
77 1.7optometry within the meaning of sections 148.52 to 148.62 who shall in any way:​
88 1.8 (1) advertise as an optometrist;​
99 1.9 (2) employ any means, including the use of autorefractors or other automated testing​
1010 1.10devices, for the measurement of the powers of vision or the adaptation of lenses or prisms​
1111 1.11for the aid thereof;​
1212 1.12 (3) possess testing appliances for the purpose of the measurement of the powers of vision;​
1313 1.13 (4) diagnose any disease, optical deficiency or deformity, or visual or muscular anomaly​
1414 1.14of the visual system consisting of the human eye and its accessory or subordinate anatomical​
1515 1.15parts;​
1616 1.16 (5) prescribe lenses, including plano or cosmetic contact lenses, or prisms for the​
1717 1.17correction or the relief of same;​
1818 1.18 (6) employ or prescribe ocular exercises, orthoptics, or habilitative and rehabilitative​
1919 1.19therapeutic vision care; or​
2020 1.20 (7) prescribe or administer legend drugs to aid in the diagnosis, cure, mitigation,​
2121 1.21prevention, treatment, or management of disease, deficiency, deformity, or abnormality of​

3232 2.2optometry, and as limited by Minnesota statute and adopted rules by the Board of Optometry,​
3333 2.3or who holds oneself out as being able to do so.​
3434 2.4 (b) In the course of treatment, nothing in this section shall allow:​
3535 2.5 (1) legend drugs to be administered intravenously, intramuscularly, or by injection,​
3636 2.6except for treatment of anaphylaxis;​
3737 2.7 (2) invasive surgery including, but not limited to, surgery using lasers;​
3838 2.8 (3) Schedule II and III oral legend drugs and oral steroids to be administered or​
3939 2.9prescribed;​
4040 2.10 (4) oral antivirals to be prescribed or administered for more than ten days; or​
4141 2.11 (5) oral carbonic anhydrase inhibitors to be prescribed or administered for more than​
4242 2.12seven days.​
4343 2.13 (c) For purposes of this subdivision, "surgery" has the meaning most recently adopted​
4444 2.14and published by the American Medical Association and the standards established by the​
4545 2.15American College of Surgeons.​
