| 6 | 6 | | 1.6 Section 1. Minnesota Statutes 2024, section 4.046, subdivision 3, is amended to read: |

| 7 | 7 | | 1.7 Subd. 3.Policy and strategy development.The subcabinet must engage in the following |

| 8 | 8 | | 1.8duties related to the development of opioid use, substance use, and addiction policy and |
|---|

| 10 | 10 | | 1.10 (1) identify challenges and opportunities that exist relating to accessing treatment and |

| 11 | 11 | | 1.11support services and develop recommendations to overcome these barriers for all |

| 13 | 13 | | 1.13 (2) with input from affected communities, develop policies and strategies that will reduce |

| 40 | 40 | | 2.11The plan must establish goals and priorities for a comprehensive continuum of care for |

| 41 | 41 | | 2.12substance misuse and substance use disorder for Minnesota. All state agencies' operating |
|---|
| 42 | 42 | | 2.13programs related to substance use prevention, harm reduction, treatment, or recovery or |
|---|
| 43 | 43 | | 2.14that are administering state or federal funds for those programs shall set program goals and |
|---|
| 44 | 44 | | 2.15priorities in accordance with the state plan. Each state agency shall submit its relevant plans |
|---|
| 45 | 45 | | 2.16and budgets to the subcabinet for review upon request. |

| 46 | 46 | | 2.17 Sec. 2. Minnesota Statutes 2024, section 254A.03, subdivision 1, is amended to read: |
|---|
| 47 | 47 | | 2.18 Subdivision 1.Alcohol and Other Drug Abuse Section.There is hereby created an |
|---|
| 48 | 48 | | 2.19Alcohol and Other Drug Abuse Section in the Department of Human Services. This section |
|---|
| 49 | 49 | | 2.20shall be headed by a director. The commissioner may place the director's position in the |
|---|
| 50 | 50 | | 2.21unclassified service if the position meets the criteria established in section 43A.08, |
|---|
| 51 | 51 | | 2.22subdivision 1a. The section shall: |

| 52 | 52 | | 2.23 (1) conduct and foster basic research relating to the cause, prevention and methods of |
|---|
| 53 | 53 | | 2.24diagnosis, treatment and recovery of persons with substance misuse and substance use |
|---|
| 54 | 54 | | 2.25disorder; |
|---|
| 55 | 55 | | 2.26 (2) coordinate and review all activities and programs of all the various state departments |
|---|
| 56 | 56 | | 2.27as they relate to problems associated with substance misuse and substance use disorder; |
|---|
| 57 | 57 | | 2.28 (3) (2) develop, demonstrate, and disseminate new methods and techniques for prevention, |
|---|
| 58 | 58 | | 2.29early intervention, treatment and recovery support for substance misuse and substance use |
|---|
| 59 | 59 | | 2.30disorder; |

| 60 | 60 | | 2.31 (4) (3) gather facts and information about substance misuse and substance use disorder, |

| 61 | 61 | | 2.32and about the efficiency and effectiveness of prevention, treatment, and recovery support |

| 64 | 64 | | 3.2commissioner of human services or the commissioner of health or accredited by the Joint |
|---|
| 65 | 65 | | 3.3Commission on Accreditation of Hospitals. The state authority is authorized to require |
|---|
| 66 | 66 | | 3.4information from comprehensive programs which is reasonable and necessary to fulfill |
|---|
| 67 | 67 | | 3.5these duties. When required information has been previously furnished to a state or local |
|---|
| 68 | 68 | | 3.6governmental agency, the state authority shall collect the information from the governmental |
|---|
| 69 | 69 | | 3.7agency. The state authority shall disseminate facts and summary information about problems |
|---|
| 70 | 70 | | 3.8associated with substance misuse and substance use disorder to public and private agencies, |
|---|
| 71 | 71 | | 3.9local governments, local and regional planning agencies, and the courts for guidance to and |
|---|
| 72 | 72 | | 3.10assistance in prevention, treatment and recovery support; |
|---|
| 73 | 73 | | 3.11 (5) (4) inform and educate the general public on substance misuse and substance use |
|---|
| 74 | 74 | | 3.12disorder; |
|---|
| 75 | 75 | | 3.13 (6) (5) serve as the state authority concerning substance misuse and substance use disorder |
|---|
| 76 | 76 | | 3.14by monitoring the conduct of diagnosis and referral services, research and comprehensive |
|---|
| 77 | 77 | | 3.15programs. The state authority shall submit a biennial report to the governor containing a |
|---|
| 78 | 78 | | 3.16description of public services delivery and recommendations concerning increase of |
|---|
| 79 | 79 | | 3.17coordination and quality of services, and decrease of service duplication and cost; |
|---|
| 80 | 80 | | 3.18 (7) establish a state plan which shall set forth goals and priorities for a comprehensive |
|---|
| 81 | 81 | | 3.19continuum of care for substance misuse and substance use disorder for Minnesota. All state |
|---|
| 82 | 82 | | 3.20agencies operating substance misuse or substance use disorder programs or administering |
|---|
| 83 | 83 | | 3.21state or federal funds for such programs shall annually set their program goals and priorities |
|---|
| 84 | 84 | | 3.22in accordance with the state plan. Each state agency shall annually submit its plans and |
|---|
| 85 | 85 | | 3.23budgets to the state authority for review. The state authority shall certify whether proposed |
|---|
| 86 | 86 | | 3.24services comply with the comprehensive state plan and advise each state agency of review |
|---|
| 87 | 87 | | 3.25findings; |
|---|
| 88 | 88 | | 3.26 (8) (6) make contracts with and grants to public and private agencies and organizations, |
|---|
| 89 | 89 | | 3.27both profit and nonprofit, and individuals, using federal funds, and state funds as authorized |
|---|
| 90 | 90 | | 3.28to pay for costs of state administration, including evaluation, statewide programs and services, |
|---|
| 91 | 91 | | 3.29research and demonstration projects, and American Indian programs; |
|---|
| 92 | 92 | | 3.30 (9) (7) receive and administer money available for substance misuse and substance use |

| 93 | 93 | | 3.31disorder programs under the alcohol, drug abuse, and mental health services block grant, |
