1.1 A bill for an act 1.2 relating to health; authorizing local health departments to obtain vaccines and a 1.3 predosed form of epinephrine according to a standing order for distribution provided 1.4 by the commissioner of health; amending Minnesota Statutes 2024, section 1.5 145A.04, by adding subdivisions. 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2024, section 145A.04, is amended by adding a subdivision 1.8to read: 1.9 Subd. 16.Epinephrine.(a) For purposes of this subdivision, "predosed form of 1.10epinephrine" means a single-use device that is approved by the Food and Drug 1.11Administration, contains a premeasured dose of epinephrine, and is used to administer 1.12epinephrine to the human body to prevent a life-threatening allergic reaction. 1.13 (b) Notwithstanding section 151.37, a local health department may obtain and possess 1.14a predosed form of epinephrine and distribute the predosed form of epinephrine to locations 1.15in the community health services area served by the local health department. A predosed 1.16form of epinephrine distributed under this paragraph may be administered to an individual 1.17if, in good faith, it is determined that the individual is experiencing a life-threatening allergic 1.18reaction. The administration of a predosed form of epinephrine under this paragraph is not 1.19the practice of medicine. 1.20 (c) At the request of a community health board, the commissioner must provide the local 1.21health departments governed by the community health board with a standing order for 1.22distribution of a predosed form of epinephrine. Minnesota Statutes 2024, section 145A.04, is amended by adding a subdivision to 2.4read: 2.5 Subd. 17.Vaccines.(a) Notwithstanding section 151.37, a local health department may 2.6obtain and possess vaccines required under section 121A.15 and Minnesota Rules, chapter 2.74604, in order to enroll or remain enrolled in an elementary or secondary school or child 2.8care facility; influenza vaccines; COVID-19 vaccines; and other vaccines as determined by 2.9the local health department. An advanced practice nurse, registered nurse, or licensed 2.10practical nurse employed by or under contract with the local health department may 2.11administer, according to a condition-specific protocol as authorized under section 148.235, 2.12subdivision 9, vaccines obtained by a local health department under this subdivision. 2.13 (b) At the request of a community health board, the commissioner must provide the local 2.14health departments governed by the community health board with a standing order for 2.15distribution of the vaccines identified by the local health department according to paragraph 2.16(a). 2Sec. 2.
