55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 216B.243, subdivision 8, is amended to read:​
77 1.7 Subd. 8.Exemptions.(a) This section does not apply to:​
88 1.8 (1) cogeneration or small power production facilities as defined in the Federal Power​
99 1.9Act, United States Code, title 16, section 796, paragraph (17), subparagraph (A), and​
1010 1.10paragraph (18), subparagraph (A), and having a combined capacity at a single site of less​
1111 1.11than 80,000 kilowatts; plants or facilities for the production of ethanol or fuel alcohol; or​
1212 1.12any case where the commission has determined after being advised by the attorney general​
1313 1.13that its application has been preempted by federal law;​
1414 1.14 (2) a high-voltage transmission line proposed primarily to distribute electricity to serve​
1515 1.15the demand of a single customer at a single location, unless the applicant opts to request​
1616 1.16that the commission determine need under this section or section 216B.2425;​
1717 1.17 (3) the upgrade to a higher voltage of an existing transmission line that serves the demand​
1818 1.18of a single customer that primarily uses existing rights-of-way, unless the applicant opts to​
1919 1.19request that the commission determine need under this section or section 216B.2425;​
2020 1.20 (4) a high-voltage transmission line of one mile or less required to connect a new or​
2121 1.21upgraded substation to an existing, new, or upgraded high-voltage transmission line;​

3737 2.712, or a solar energy generating system, as defined in section 216I.02, subdivision 18, for​
3838 2.8which a site permit application is submitted by an independent power producer under chapter​
3939 2.9216I;​
4040 2.10 (8) a large wind energy conversion system, as defined in section 216I.02, subdivision​
4141 2.1112, or a solar energy generating system, as defined in section 216I.02, subdivision 18,​
4242 2.12engaging in a repowering project that:​
4343 2.13 (i) will not result in the system exceeding the nameplate capacity under its most recent​
4444 2.14interconnection agreement; or​
4545 2.15 (ii) will result in the system exceeding the nameplate capacity under its most recent​
4646 2.16interconnection agreement, provided that the Midcontinent Independent System Operator​
4747 2.17has provided a signed generator interconnection agreement that reflects the expected net​
4848 2.18power increase;​
4949 2.19 (9) energy storage systems, as defined in section 216I.02, subdivision 6;​
5050 2.20 (10) transmission lines that directly interconnect large wind energy conversion systems,​
5151 2.21solar energy generating systems, or energy storage systems to the transmission system; or​
5252 2.22 (11) relocation of an existing high voltage transmission line to new right-of-way, provided​
5353 2.23that any new structures that are installed are not designed for and capable of operation at​
5454 2.24higher voltage.; or​
5555 2.25 (12) a new or modified electric generating facility that is primarily intended to provide​
5656 2.26power to a data center if the electric generating facility complies with section 216B.1691,​
5757 2.27subdivision 2g.​
5858 2.28 (b) For the purpose of this subdivision,:​
5959 2.29 (1) "data center" means a physical location that stores a large group of networked​
6060 2.30computer servers that are used to remotely store, process, or distribute large amounts of​
6161 2.31digital data; and​
6262 2.32 (2) "repowering project" means:​
