5	5	1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
6	6	1.6 Section 1. Minnesota Statutes 2024, section 216B.243, subdivision 8, is amended to read:
7	7	1.7 Subd. 8.Exemptions.(a) This section does not apply to:
8	8	1.8 (1) cogeneration or small power production facilities as defined in the Federal Power
9	9	1.9Act, United States Code, title 16, section 796, paragraph (17), subparagraph (A), and
10	10	1.10paragraph (18), subparagraph (A), and having a combined capacity at a single site of less
11	11	1.11than 80,000 kilowatts; plants or facilities for the production of ethanol or fuel alcohol; or
12	12	1.12any case where the commission has determined after being advised by the attorney general
13	13	1.13that its application has been preempted by federal law;
14	14	1.14 (2) a high-voltage transmission line proposed primarily to distribute electricity to serve
15	15	1.15the demand of a single customer at a single location, unless the applicant opts to request
16	16	1.16that the commission determine need under this section or section 216B.2425;
17	17	1.17 (3) the upgrade to a higher voltage of an existing transmission line that serves the demand
18	18	1.18of a single customer that primarily uses existing rights-of-way, unless the applicant opts to
19	19	1.19request that the commission determine need under this section or section 216B.2425;
20	20	1.20 (4) a high-voltage transmission line of one mile or less required to connect a new or
21	21	1.21upgraded substation to an existing, new, or upgraded high-voltage transmission line;

31	31	The bill was read for the first time and referred to the Committee on Energy Finance and Policy 2.1 (5) conversion of the fuel source of an existing electric generating plant to using natural
32	32	2.2gas;
33	33	2.3 (6) the modification of an existing electric generating plant to increase efficiency, as
34	34	2.4long as the capacity of the plant is not increased more than ten percent or more than 100
35	35	2.5megawatts, whichever is greater;
36	36	2.6 (7) a large wind energy conversion system, as defined in section 216I.02, subdivision
37	37	2.712, or a solar energy generating system, as defined in section 216I.02, subdivision 18, for
38	38	2.8which a site permit application is submitted by an independent power producer under chapter
39	39	2.9216I;
40	40	2.10 (8) a large wind energy conversion system, as defined in section 216I.02, subdivision
41	41	2.1112, or a solar energy generating system, as defined in section 216I.02, subdivision 18,
42	42	2.12engaging in a repowering project that:
43	43	2.13 (i) will not result in the system exceeding the nameplate capacity under its most recent
44	44	2.14interconnection agreement; or
45	45	2.15 (ii) will result in the system exceeding the nameplate capacity under its most recent
46	46	2.16interconnection agreement, provided that the Midcontinent Independent System Operator
47	47	2.17has provided a signed generator interconnection agreement that reflects the expected net
48	48	2.18power increase;
49	49	2.19 (9) energy storage systems, as defined in section 216I.02, subdivision 6;
50	50	2.20 (10) transmission lines that directly interconnect large wind energy conversion systems,
51	51	2.21solar energy generating systems, or energy storage systems to the transmission system; or
52	52	2.22 (11) relocation of an existing high voltage transmission line to new right-of-way, provided
53	53	2.23that any new structures that are installed are not designed for and capable of operation at
54	54	2.24higher voltage.; or
55	55	2.25 (12) a new or modified electric generating facility that is primarily intended to provide
56	56	2.26power to a data center if the electric generating facility complies with section 216B.1691,
57	57	2.27subdivision 2g.
58	58	2.28 (b) For the purpose of this subdivision,:
59	59	2.29 (1) "data center" means a physical location that stores a large group of networked
60	60	2.30computer servers that are used to remotely store, process, or distribute large amounts of
61	61	2.31digital data; and
62	62	2.32 (2) "repowering project" means:

65	65	3.2system that is a large energy facility to increase its efficiency without increasing its nameplate
66	66	3.3capacity;
67	67	3.4 (2) (ii) replacing turbines in a large wind energy conversion system without increasing
68	68	3.5the nameplate capacity of the system; or
69	69	3.6 (3) (iii) increasing the nameplate capacity of a large wind energy conversion system.
