                            1.1	A bill for an act​
1.2 relating to human services; modifying coverage and payment for certain pharmacy​
1.3 services; amending Minnesota Statutes 2024, sections 256B.0625, by adding a​
1.4 subdivision; 256L.03, by adding a subdivision.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. Minnesota Statutes 2024, section 256B.0625, is amended by adding a subdivision​
1.7to read:​
1.8 Subd. 13l.Coverage and payment for certain pharmacy services.(a) Medical​
1.9assistance covers services provided by a licensed pharmacist under the coverage for services​
1.10provided by a licensed physician to the extent the licensed pharmacist's services are within​
1.11both a pharmacist's and physician's scope of practice.​
1.12 (b) This subdivision applies to licensed pharmacist services provided:​
1.13 (1) under fee-for-service medical assistance; or​
1.14 (2) by a managed care plan under section 256B.69 or a county-based purchasing plan​
1.15under section 256B.692.​
1.16 (c) The commissioner, and managed care and county-based purchasing plans when​
1.17providing services under sections 256B.69 and 256B.692, must reimburse a participating​
1.18pharmacist or pharmacy for a service that is within both a pharmacist's and physician's scope​
1.19of practice at an amount no lower than the standard payment rate applied when reimbursing​
1.20a physician for the service.​

2.2whichever is later. The commissioner of human services must notify the revisor of statutes​
2.3when federal approval is obtained.​
2.4 Sec. 2. Minnesota Statutes 2024, section 256L.03, is amended by adding a subdivision to​
2.5read:​
2.6 Subd. 7.Coverage and payment for certain pharmacy services.MinnesotaCare must​
2.7cover and pay for pharmacy services in compliance with the requirements for medical​
2.8assistance specified under section 256B.0625, subdivision 13l.​
2.9 EFFECTIVE DATE.This section is effective January 1, 2026, or upon federal approval,​
2.10whichever is later. The commissioner of human services must notify the revisor of statutes​
2.11when federal approval is obtained.​
