8 | 8 | | 1.8 Subd. 6a.Priority placement.(a) If no reasonable accommodation under subdivision |
---|
9 | 9 | | 1.96 is possible within the employee's current position, priority placement under this subdivision |
---|
10 | 10 | | 1.10applies to any available positions for which the disabled employee meets the qualifications, |
---|
11 | 11 | | 1.11subject to any reasonable accommodation requirements for the new position. An employer |
---|
12 | 12 | | 1.12must provide priority placement in an open position to any employee who becomes disabled |
---|
13 | 13 | | 1.13and is unable to perform the essential functions of their current role, provided that the |
---|
14 | 14 | | 1.14employee is qualified for the open position. |
---|
15 | 15 | | 1.15 (b) Priority placement means that the disabled employee must be considered before |
---|
16 | 16 | | 1.16external candidates for any open role for which the employee is qualified and capable of |
---|
17 | 17 | | 1.17performing with or without reasonable accommodation. |

18 | 18 | | 1.18 (c) This section applies to employers with more than 40,000 employees in the state. An |

19 | 19 | | 1.19employer subject to this subdivision must notify employees of their right to priority placement |
