44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. ST. CLOUD; REDEVELOPMENT DISTRICTS SALES AND USE TAX​

77 1.7 Subdivision 1.Exemption; refund.(a) Materials and supplies used in and equipment​
88 1.8incorporated into private redevelopment projects on parcels listed in paragraph (b) are​
99 1.9exempt from sales and use tax under Minnesota Statutes, chapter 297A, provided the resulting​
1010 1.10development is subject to property taxes.​

3333 2.3 (c) The tax must be imposed and collected as if the rate under Minnesota Statutes, section​
3434 2.4297A.62, subdivisions 1 and 1a, applied. A refund equal to the tax paid on the gross receipts​
3535 2.5of items exempt under this section must be paid to the applicant. The applicant must be the​
3636 2.6owner of the development described in paragraph (b), clauses (1) and (2). The application​
3737 2.7must include sufficient information to permit the commissioner of revenue to verify the tax​
3838 2.8paid. If the tax was paid by a contractor, subcontractor, or builder, the contractor,​
3939 2.9subcontractor, or builder must furnish to the refund applicant a statement including the cost​
4040 2.10of the exempt items and the taxes paid on the items. The provisions of Minnesota Statutes,​
4141 2.11sections 289A.40 and 289A.50, apply to refunds under this section.​
4242 2.12 (d) The exemption under this section applies for sales and purchases made after July 1,​
4343 2.132025, and before December 31, 2040.​
4444 2.14 Subd. 2.Appropriation; limit on refunds.The amount required to pay the refunds​
4545 2.15under subdivision 1 is appropriated from the general fund to the commissioner of revenue.​
4646 2.16The commissioner of revenue must not pay more than $13,000,000 in refunds for purchases​
4747 2.17exempt under this section. Refunds must be processed and issued in the order that complete​
4848 2.18and accurate applications are received by the commissioner of revenue.​
4949 2.19 EFFECTIVE DATE.This section is effective the day following final enactment.​
