| 5 | 5 | | 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

| 6 | 6 | | 1.6 Section 1. Minnesota Statutes 2024, section 216B.40, is amended to read: |

| 7 | 7 | | 1.7 216B.40 EXCLUSIVE SERVICE RIGHT; SERVICE EXTENSION. |

| 8 | 8 | | 1.8 (a) Except as provided in paragraph (b) and sections 216B.42 and 216B.421, each electric |

| 9 | 9 | | 1.9utility shall have the exclusive right to provide electric service at retail to each and every |
|---|
| 10 | 10 | | 1.10present and future customer in its assigned service area and no electric utility shall render |
|---|
| 11 | 11 | | 1.11or extend electric service at retail within the assigned service area of another electric utility |

| 12 | 12 | | 1.12unless the electric utility consents thereto in writing; provided that any electric utility may |

| 13 | 13 | | 1.13extend its facilities through the assigned service area of another electric utility if the extension |
|---|
| 14 | 14 | | 1.14is necessary to facilitate the electric utility connecting its facilities or customers within its |
|---|
| 15 | 15 | | 1.15own assigned service area. |

| 16 | 16 | | 1.16 (b) Notwithstanding any other law, an electric utility must not prohibit or prevent a |

| 17 | 17 | | 1.17Minnesota Tribal government, as defined in section 10.65, from installing an electric |
|---|
| 18 | 18 | | 1.18generation facility or device to provide electricity to a building owned and operated by the |
|---|
| 19 | 19 | | 1.19Minnesota Tribal government. |

| 20 | 20 | | 1.20 EFFECTIVE DATE.This section is effective the day following final enactment. |
