55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 216B.40, is amended to read:​
77 1.7 216B.40 EXCLUSIVE SERVICE RIGHT; SERVICE EXTENSION.​
88 1.8 (a) Except as provided in paragraph (b) and sections 216B.42 and 216B.421, each electric​
99 1.9utility shall have the exclusive right to provide electric service at retail to each and every​
1010 1.10present and future customer in its assigned service area and no electric utility shall render​
1111 1.11or extend electric service at retail within the assigned service area of another electric utility​
1212 1.12unless the electric utility consents thereto in writing; provided that any electric utility may​
1313 1.13extend its facilities through the assigned service area of another electric utility if the extension​
1414 1.14is necessary to facilitate the electric utility connecting its facilities or customers within its​
1515 1.15own assigned service area.​
1616 1.16 (b) Notwithstanding any other law, an electric utility must not prohibit or prevent a​
1717 1.17Minnesota Tribal government, as defined in section 10.65, from installing an electric​
1818 1.18generation facility or device to provide electricity to a building owned and operated by the​
1919 1.19Minnesota Tribal government.​
2020 1.20 EFFECTIVE DATE.This section is effective the day following final enactment.​
