44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. CITATION.​
66 1.6 This act may be cited as the Minnesota Cigar Bar Act.​
77 1.7 Sec. 2. Minnesota Statutes 2024, section 340A.404, subdivision 1, is amended to read:​
88 1.8 Subdivision 1.Cities.(a) A city may issue an on-sale intoxicating liquor license to the​
99 1.9following establishments located within its jurisdiction:​
1010 1.10 (1) hotels;​
1111 1.11 (2) restaurants;​
1212 1.12 (3) bowling centers;​
1313 1.13 (4) clubs or congressionally chartered veterans organizations with the approval of the​
1414 1.14commissioner, provided that the organization has been in existence for at least three years​
1515 1.15and liquor sales will only be to members and bona fide guests, except that a club may permit​
1616 1.16the general public to participate in a wine tasting conducted at the club under section​
1717 1.17340A.419;​
1818 1.18 (5) sports facilities, restaurants, clubs, or bars located on land owned or leased by the​
1919 1.19Minnesota Sports Facilities Authority;​
2020 1.20 (6) sports facilities located on land owned by the Metropolitan Sports Commission;​

3030 The bill was read for the first time and referred to the Committee on Commerce Finance and Policy​ 2.1 (7) exclusive liquor stores; and​
3131 2.2 (8) resorts as defined in section 157.15, subdivision 11.; and​
3232 2.3 (9) a cigar bar or other tobacco products shop under section 144.4167, subdivision 4.​
3333 2.4 (b) A city may issue an on-sale intoxicating liquor license, an on-sale wine license, or​
3434 2.5an on-sale malt liquor license to a theater within the city, notwithstanding any law, local​
3535 2.6ordinance, or charter provision. A license issued under this paragraph authorizes sales on​
3636 2.7all days of the week to persons attending events at the theater.​
3737 2.8 (c) A city may issue an on-sale intoxicating liquor license, an on-sale wine license, or​
3838 2.9an on-sale malt liquor license to a convention center within the city, notwithstanding any​
3939 2.10law, local ordinance, or charter provision. A license issued under this paragraph authorizes​
4040 2.11sales on all days of the week to persons attending events at the convention center. This​
4141 2.12paragraph does not apply to convention centers located in the seven-county metropolitan​
4242 2.13area.​
4343 2.14 (d) A municipality may issue an on-sale wine license and an on-sale malt liquor license​
4444 2.15to a person who is the owner of a summer collegiate league baseball team or baseball team​
4545 2.16competing in a league established by the Minnesota Baseball Association, or to a person​
4646 2.17holding a concessions or management contract with the owner, for beverage sales at a​
4747 2.18ballpark or stadium located within the municipality for the purposes of summer collegiate​
4848 2.19league baseball games, town ball games, and any other events at the ballpark or stadium,​
4949 2.20notwithstanding any law, local ordinance, or charter provision. A license issued under this​
5050 2.21paragraph authorizes sales on all days of the week to persons attending baseball games and​
5151 2.22any other events at the ballpark or stadium.​
5252 2.23 (e) A municipality may issue an on-sale malt liquor license to a resort as defined in​
5353 2.24section 157.15, subdivision 11, notwithstanding any law, local ordinance, or charter provision.​
5454 2.25A license issued under this paragraph authorizes sales on all days of the week to persons​
5555 2.26staying at the resort and their guests.​
5656 2.27 EFFECTIVE DATE.This section is effective the day following final enactment.​
