| 6 | 6 | | 1.6 This act may be cited as the Minnesota Cigar Bar Act. |

| 7 | 7 | | 1.7 Sec. 2. Minnesota Statutes 2024, section 340A.404, subdivision 1, is amended to read: |

| 8 | 8 | | 1.8 Subdivision 1.Cities.(a) A city may issue an on-sale intoxicating liquor license to the |

| 9 | 9 | | 1.9following establishments located within its jurisdiction: |

| 11 | 11 | | 1.11 (2) restaurants; |
|---|
| 12 | 12 | | 1.12 (3) bowling centers; |

| 13 | 13 | | 1.13 (4) clubs or congressionally chartered veterans organizations with the approval of the |

| 14 | 14 | | 1.14commissioner, provided that the organization has been in existence for at least three years |

| 15 | 15 | | 1.15and liquor sales will only be to members and bona fide guests, except that a club may permit |
|---|
| 16 | 16 | | 1.16the general public to participate in a wine tasting conducted at the club under section |

| 35 | 35 | | 2.6ordinance, or charter provision. A license issued under this paragraph authorizes sales on |

| 36 | 36 | | 2.7all days of the week to persons attending events at the theater. |

| 37 | 37 | | 2.8 (c) A city may issue an on-sale intoxicating liquor license, an on-sale wine license, or |
|---|
| 38 | 38 | | 2.9an on-sale malt liquor license to a convention center within the city, notwithstanding any |
|---|
| 39 | 39 | | 2.10law, local ordinance, or charter provision. A license issued under this paragraph authorizes |
|---|
| 40 | 40 | | 2.11sales on all days of the week to persons attending events at the convention center. This |
|---|
| 41 | 41 | | 2.12paragraph does not apply to convention centers located in the seven-county metropolitan |
|---|
| 42 | 42 | | 2.13area. |

| 43 | 43 | | 2.14 (d) A municipality may issue an on-sale wine license and an on-sale malt liquor license |

| 44 | 44 | | 2.15to a person who is the owner of a summer collegiate league baseball team or baseball team |
|---|
| 45 | 45 | | 2.16competing in a league established by the Minnesota Baseball Association, or to a person |
|---|
| 46 | 46 | | 2.17holding a concessions or management contract with the owner, for beverage sales at a |
|---|
| 47 | 47 | | 2.18ballpark or stadium located within the municipality for the purposes of summer collegiate |
|---|
| 48 | 48 | | 2.19league baseball games, town ball games, and any other events at the ballpark or stadium, |
|---|
| 49 | 49 | | 2.20notwithstanding any law, local ordinance, or charter provision. A license issued under this |
|---|
| 50 | 50 | | 2.21paragraph authorizes sales on all days of the week to persons attending baseball games and |
|---|
| 51 | 51 | | 2.22any other events at the ballpark or stadium. |

| 52 | 52 | | 2.23 (e) A municipality may issue an on-sale malt liquor license to a resort as defined in |
|---|
| 53 | 53 | | 2.24section 157.15, subdivision 11, notwithstanding any law, local ordinance, or charter provision. |
|---|
| 54 | 54 | | 2.25A license issued under this paragraph authorizes sales on all days of the week to persons |
|---|
| 55 | 55 | | 2.26staying at the resort and their guests. |
|---|
| 56 | 56 | | 2.27 EFFECTIVE DATE.This section is effective the day following final enactment. |
