1.1 A bill for an act
1.2 relating to commerce; prohibiting the sale of flavored nitrous oxide; proposing
1.3 coding for new law in Minnesota Statutes, chapter 325F.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. [325F.079] SALE OF FLAVORED NITROUS OXIDE.
1.6 Subdivision 1.Definitions.(a) For purposes of this section, the following terms have
1.7the meanings given.
1.8 (b) "Flavored nitrous oxide" means a canister containing nitrous oxide that (1) imparts
1.9a taste or smell, and (2) is sold by a retailer.
1.10 (c) "Retailer" means a person, whether located within Minnesota or otherwise, engaged
1.11in the business of selling or offering for sale flavored nitrous oxide to a consumer in
1.12Minnesota.
1.13 Subd. 2.Prohibition.A retailer is prohibited from selling or offering for sale flavored
1.14nitrous oxide to a consumer in Minnesota.
1.15 Subd. 3.Violation.A person who violates this section is guilty of a misdemeanor.
