1.1 A bill for an act 1.2 relating to transportation; modifying the programming and administration duties 1.3 of the Advisory Council on Traffic Safety; amending Minnesota Statutes 2024, 1.4 section 4.076, subdivisions 4, 5; Laws 2023, chapter 68, article 1, section 4, 1.5 subdivision 5. 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2024, section 4.076, subdivision 4, is amended to read: 1.8 Subd. 4.Duties.The advisory council must: 1.9 (1) advise the governor and heads of state departments and agencies on policies, programs, 1.10and services affecting traffic safety; 1.11 (2) advise the appropriate representatives of state departments on the activities of the 1.12Toward Zero Deaths program, including but not limited to educating the public about traffic 1.13safety; 1.14 (3) encourage state departments and other agencies to conduct needed research in the 1.15field of traffic safety; 1.16 (4) review recommendations of the subcommittees and working groups; 1.17 (5) review and comment on all grants dealing with traffic safety and on the development 1.18and implementation of state and local traffic safety plans; and 1.19 (6) advise the commissioner of public safety on grant agreements for projects under 1.20subdivision 5, paragraph (g); and 1.21 (6) (7) make recommendations on safe road zone safety measures under section 169.065. 1Section 1. Minnesota Statutes 2024, section 4.076, subdivision 5, is amended to read: 2.3 Subd. 5.Administration.(a) The Office of Traffic Safety in the Department of Public 2.4Safety, in cooperation with the Departments of Transportation and Health, must serve as 2.5the host agency for the advisory council and must manage the administrative and operational 2.6aspects of the advisory council's activities. The commissioner of public safety must perform 2.7financial management on behalf of the council. 2.8 (b) The advisory council must meet no less than four times per year, or more frequently 2.9as determined by the chair, a vice chair, or a majority of the council members. The advisory 2.10council is subject to chapter 13D. 2.11 (c) The chair must regularly report to the respective commissioners on the activities of 2.12the advisory council and on the state of traffic safety in Minnesota. 2.13 (d) The terms, compensation, and appointment of members are governed by section 2.1415.059. 2.15 (e) The advisory council may appoint subcommittees and working groups. Subcommittees 2.16must consist of council members. Working groups may include nonmembers. Nonmembers 2.17on working groups must be compensated pursuant to section 15.059, subdivision 3, only 2.18for expenses incurred for working group activities. 2.19 (f) The commissioner of public safety may enter into contracts and interagency 2.20agreements for data, expertise, and research projects to inform the council. The advisory 2.21council may host an annual state traffic safety conference. 2.22 (g) The commissioner of public safety may enter into grant agreements for projects that 2.23reduce serious and fatal injury crashes. Priority for grant awards must be given to local 2.24traffic safety coalitions. Local units of government, nonprofit organizations, law enforcement 2.25agencies, and educational institutions are also eligible for grant awards. 2.26 EFFECTIVE DATE.This section is effective the day following final enactment. 2.27 Sec. 3. In 3.8allocating funds, the commissioner must 3.9account for other sources of funding for 3.10increased traffic enforcement. 3.11$2,000,000 in fiscal year 2024 is from the 3.12general fund for grants to local units of 3.13government to increase traffic safety 3.14enforcement activities, including training, 3.15equipment, overtime, and related costs for 3.16peace officers to perform duties that are 3.17specifically related to traffic management and 3.18traffic safety. 3.19$2,000,000 in fiscal year 2024 is from the 3.20general fund for grants to law enforcement 3.21agencies to undertake targeted speed reduction 3.22efforts on rural high-risk roadways identified 3.23by the commissioner based on crash 3.24information and consultation with the 3.25Advisory Council on Traffic Safety under 3.26Minnesota Statutes, section 4.076, and local 3.27traffic safety partners. 3.28$50,000 in fiscal year 2024 is from the general 3.29fund for an education and awareness campaign 3.30on motor vehicles passing school buses, 3.31designed to: (1) help reduce occurrences of 3.32motor vehicles unlawfully passing school 3.33buses; and (2) inform drivers about the safety 3.34of pupils boarding and unloading from school 3.35buses, including laws requiring a motor 3Sec. 3. REVISOR KRB/LJ 25-0544804/07/25 4.1vehicle to stop when a school bus has extended 4.2the stop-signal arm and is flashing red lights 4.3and penalties for violations. The commissioner 4.4must identify best practices, review effective 4.5communication methods to educate drivers, 4.6and consider multiple forms of media to 4.7convey the information. 4.8$100,000 in fiscal year 2024 is from the 4.9general fund for a public awareness campaign 4.10to promote understanding and compliance with 4.11laws regarding the passing of parked 4.12authorized vehicles. 4.13$350,000 in fiscal year 2024 is from the 4.14general fund for grants to local units of 4.15government for safe ride programs that 4.16provide safe transportation options for patrons 4.17of hospitality and entertainment businesses 4.18within a community. 4.19$250,000 in fiscal year 2024 is from the 4.20general fund for the traffic safety violations 4.21disposition analysis under article 4, section 4.22109. 4.23$2,000,000 in each year is from the general 4.24fund for operations and traffic safety projects, 4.25grants, and activities of the Advisory Council 4.26on Traffic Safety under Minnesota Statutes, 4.27section 4.076. 4.28$98,000 in each year is from the general fund 4.29to coordinate a statewide traffic safety equity 4.30program, including staff costs. 4.31The following amounts are for the staff and 4.32operating costs related to a Traffic Safety Data 4.33Analytics Center: (1) $407,000 in fiscal year 4.342024 and $813,000 in fiscal year 2025 from 4Sec. 3.
