| 6 | 6 | | 1.6 Section 1. Minnesota Statutes 2024, section 121A.425, subdivision 1, is amended to read: |

| 7 | 7 | | 1.7 Subdivision 1.Disciplinary dismissals prohibited.(a) A pupil enrolled in the following |

| 8 | 8 | | 1.8is not subject to dismissals under this chapter: |

| 9 | 9 | | 1.9 (1) a preschool or prekindergarten program, including an a child participating in early |
|---|
| 10 | 10 | | 1.10childhood family education, school readiness, school readiness plus, voluntary |
|---|
| 11 | 11 | | 1.11prekindergarten, Head Start, or other school-based preschool or prekindergarten program; |
|---|
| 12 | 12 | | 1.12or is not subject to dismissals under this chapter. |
|---|
| 13 | 13 | | 1.13 (2) kindergarten through grade 3. |
|---|
| 14 | 14 | | 1.14 (b) This provision subdivision does not apply to a dismissal from school for less than |

| 15 | 15 | | 1.15one school day, except as provided under chapter 125A and federal law for a student receiving |

| 16 | 16 | | 1.16special education services. |

| 17 | 17 | | 1.17 (c) Notwithstanding this subdivision, expulsions and exclusions may be used only after |
