44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. RULEMAKING; LOSS OF VOLUNTARY CONTROL PROVISIONS​
66 1.6MODIFICATION.​
7-1.7 (a) By July 1, 2026, the commissioner of public safety must amend Minnesota Rules,​
8-1.8part 7410.2500, subpart 5, by adding an item F, to no longer require an annual physician's​
9-1.9statement from a driver if:​
10-1.10 (1) a single nonepileptic seizure was responsible for the driver's loss of consciousness​
11-1.11or voluntary control;​
12-1.12 (2) the driver has been free from episodes of loss of consciousness or voluntary control​
13-1.13for five years from the date of the incident under clause (1);​
14-1.14 (3) the driver has not been prescribed or taking any antiseizure medication for five years​
15-1.15from the date of the incident under clause (1); and​
16-1.16 (4) a physician has indicated that no further review of the driver's condition is necessary​
17-1.17due to the driver being in good health and the risk of reoccurrence for the condition​
18-1.18responsible for causing a loss of consciousness or voluntary control is minimal.​
19-1.19 (b) By July 1, 2026, the commissioner of public safety must amend Minnesota Rules,​
20-1.20part 7410.2500, subpart 5, by adding an item G, to no longer require an annual physician's​
21-1.21statement from a driver if:​
7+1.7 (a) By January 1, 2026, the commissioner of public safety must amend Minnesota Rules,​
8+1.8part 7410.2500, subpart 5, item E, to provide that a physician may:​
9+1.9 (1) identify whether the person has either:​
10+1.10 (i) a medical history of epilepsy or a seizure disorder; or​
11+1.11 (ii) a single nonepileptic seizure responsible for the loss of consciousness or voluntary​
12+1.12control;​
13+1.13 (2) affirm the person is in good health and the risk of reoccurrence for the condition​
14+1.14responsible for causing a loss of consciousness or voluntary control is minimal by either:​
15+1.15 (i) for persons under clause (1), item (i), affirming that the person for the last ten years​
16+1.16or more was:​
17+1.17 (A) not prescribed or taking antiseizure medication; and​
18+1.18 (B) seizure or episode free; or​
19+1.19 (ii) for persons under clause (1), item (ii), affirming that the person for the last five years​
20+1.20or more was:​

41-2.10under Code of Federal Regulations, title 49, section 391.43, and does not constitute a​
42-2.11determination of that driver's physical qualifications as required under Code of Federal​
43-2.12Regulations, title 49, section 391.41.​
44-2.13 (d) The commissioner may use the good cause exemption under Minnesota Statutes,​
45-2.14section 14.388, subdivision 1, clause (3), to adopt rules under this section. Minnesota​
46-2.15Statutes, section 14.386, does not apply except as provided under Minnesota Statutes, section​
47-2.1614.388.​
48-2.17 EFFECTIVE DATE.This section is effective the day following final enactment.​
49-2.18 Sec. 2. APPROPRIATION.​
50-2.19 $11,000 in fiscal year 2026 is appropriated from the driver and vehicle services operating​
51-2.20account under Minnesota Statutes, section 299A.705, to the commissioner of public safety​
52-2.21for the costs of rulemaking under section 1.​
