                            1.1	A bill for an act​
1.2 relating to environment; repealing requirement for residents who do not recycle​
1.3 to pay for recycling services; amending Minnesota Statutes 2024, section 115A.93,​
1.4 subdivision 3.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. Minnesota Statutes 2024, section 115A.93, subdivision 3, is amended to read:​
1.7 Subd. 3.License requirements; pricing based on volume or weight.(a) A licensing​
1.8authority shall require licensees to impose charges for collection of mixed municipal solid​
1.9waste that increase with the volume or weight of the waste collected.​
1.10 (b) A licensing authority may impose requirements that are consistent with the county's​
1.11solid waste policies as a condition of receiving and maintaining a license.​
1.12 (c) A licensing authority shall prohibit mixed municipal solid waste collectors from​
1.13imposing a greater charge on residents who recycle than on residents who do not recycle.​
1.14 (d) (c) The commissioner may exempt a licensing authority from the requirements of​
1.15paragraph (a) if the county within which the authority is located has an approved solid waste​
1.16management plan that concludes that variable rate pricing is not appropriate for that​
1.17jurisdiction because it is inconsistent with other incentives and mechanisms implemented​
1.18within the jurisdiction that are more effective in attaining the goals of this chapter to​
1.19discourage on-site disposal, littering, and illegal dumping.​
1.20 (e) (d) In the interim between revisions to the county solid waste management plan, the​
1.21commissioner may exempt a licensing authority from the requirements of paragraph (a) if​

The bill was read for the first time and referred to the Committee on Environment and Natural Resources Finance and Policy​ 2.1the commissioner makes the determination otherwise made by the plan in paragraph (d) (c)​
2.2and finds that the licensing authority:​
2.3 (1) operates or contracts for the operation of a residential recycling program that collects​
2.4more categories of recyclable materials than required in section 115A.552;​
2.5 (2) has a residential participation rate in its recycling programs of at least 70 percent or​
2.6in excess of the participation rate for the county in which it is located, whichever is greater;​
2.7and​
2.8 (3) is located in a county that has exceeded the recycling goals in section 115A.551.​
2.9An exemption granted by the commissioner in the interim between revisions to the county​
2.10solid waste management plan is only effective until the county solid waste management​
2.11plan is revised.​
