1.1 A bill for an act 1.2 relating to drivers' licenses; modifying voter registration information on applications 1.3 for drivers' licenses and identification cards; amending Minnesota Statutes 2024, 1.4 section 171.06, subdivisions 1, 8. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 171.06, subdivision 1, is amended to read: 1.7 Subdivision 1.Application format and requirements.Every application for a Minnesota 1.8identification card, including an enhanced identification card, or for a driver's license, 1.9including an instruction permit, a provisional license, a noncompliant driver's license, a 1.10REAL ID driver's license, and an enhanced driver's license, must be made in a format 1.11approved by the department. Every application must be accompanied by payment of the 1.12proper fee. All applicants must sign the application and declare, under penalty of perjury, 1.13that the information and documentation presented in the application is true and correct. All 1.14applications requiring evidence of legal presence in the United States or United States 1.15citizenship must be signed in the presence of the person authorized to accept the application, 1.16or the signature on the application may be verified by a notary public. Every application 1.17must include the following statement: "Only citizens of the United States are eligible to 1.18vote. If you are not a citizen, you are not eligible to vote. Voting if you are not eligible to 1.19vote is a felony that is punishable by not more than five years imprisonment and a fine of 1.20not more than $10,000, or both. A felony conviction may lead to deportation in some 1.21instances." 1Section 1. Minnesota Statutes 2024, section 171.06, subdivision 8, is amended to read: 2.2 Subd. 8.Noncompliant license or identification card; residence, lawful status.(a) 2.3A person who applies for a noncompliant driver's license or identification card: 2.4 (1) must declare the applicant's residence address in Minnesota; and 2.5 (2) is not required must be asked to demonstrate United States citizenship or lawful 2.6presence in the United States. 2.7 (b) The commissioner or driver's license agent must record whether United States 2.8citizenship or lawful presence in the United States was demonstrated and, if so, which 2.9documents were provided. Data collected pursuant to this paragraph must only be used for 2.10the purpose of improving the accuracy of voter registration records under section 171.12, 2.11subdivision 7a. 2.12 (b) (c) Minnesota Rules, part 7410.0410, or any successor rule, does not apply for a 2.13noncompliant driver's license or identification card. 2.14 (c) (d) Nothing in this section allows the commissioner to issue a commercial driver's 2.15license to an applicant who does not demonstrate proof of citizenship or immigration status 2.16if required by federal law. 2Sec. 2.
