66 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
77 1.7 Section 1. Minnesota Statutes 2024, section 244.05, subdivision 6, is amended to read:​
88 1.8 Subd. 6.Intensive supervised release.(a) The commissioner may order that an inmate​
99 1.9be placed on intensive supervised release for:​
1010 1.10 (1) all or part of the inmate's supervised release or parole term; or​
1111 1.11 (2) all of the inmate's conditional or supervised release term if the inmate was:​
1212 1.12 (i) convicted of a sex offense under section 609.342, 609.343, 609.344, 609.345, or​
1313 1.13609.3453; or​
1414 1.14 (ii) sentenced under section 609.3455, subdivision 3a.​
1515 1.15 (b) The commissioner must order that all level III predatory offenders be placed on​
1616 1.16intensive supervised release, which must include electronic surveillance, for the entire​
1717 1.17supervised release, conditional release, or parole term.​
1818 1.18 (c) The commissioner may impose appropriate conditions of release on an inmate,​
1919 1.19including but not limited to:​
2020 1.20 (1) unannounced searches by an intensive supervision agent of the inmate's person,​
2121 1.21vehicle, premises, computer, or other electronic devices capable of accessing the Internet;​

3131 The bill was read for the first time and referred to the Committee on Public Safety Finance and Policy​ 2.1 (2) compliance with court-ordered restitution, if any;​
3232 2.2 (3) random drug testing;​
3333 2.3 (4) house arrest;​
3434 2.4 (5) daily curfews;​
3535 2.5 (6) frequent face-to-face contacts with an assigned intensive supervision agent;​
3636 2.6 (7) work, education, or treatment requirements; and​
3737 2.7 (8) electronic surveillance.​
3838 2.8 (d) A sex offender placed on intensive supervised release may be ordered to participate​
3939 2.9in an appropriate sex offender program as a condition of release.​
4040 2.10 (e) If electronic surveillance is directed for an inmate on intensive supervised release,​
4141 2.11the commissioner must require that until electronic surveillance is activated:​
4242 2.12 (1) the inmate be kept in custody; or​
4343 2.13 (2) the inmate's intensive supervision agent, or the agent's designee, directly supervise​
4444 2.14the inmate.​
4545 2.15 (f) Before being released from custody or the direct supervision of an intensive​
4646 2.16supervision agent, an inmate placed on electronic surveillance must ensure that:​
4747 2.17 (1) the inmate's residence is properly equipped to support electronic surveillance; and​
4848 2.18 (2) the inmate's telecommunications system is properly configured to support electronic​
4949 2.19surveillance.​
5050 2.20 (g) An inmate who fails to comply with paragraph (f) may be found in violation of the​
5151 2.21inmate's conditions of release after a revocation hearing.​
5252 2.22 (h) As a condition of release for an inmate required to register under section 243.166​
5353 2.23who is placed on intensive supervised release under this subdivision, the commissioner shall​
5454 2.24prohibit the inmate from accessing, creating, or maintaining a personal web page, profile,​
5555 2.25account, password, or username for (1) a social networking website, or (2) an instant​
5656 2.26messaging or chat room program, any of which permits persons under the age of 18 to​
5757 2.27become a member or to create or maintain a personal web page.​
5858 2.28 (i) An intensive supervision agent may modify the prohibition under paragraph (h) if:​
5959 2.29 (1) the modification would not jeopardize public safety; and​
6060 2.30 (2) the modification is specifically described and agreed to in advance by the agent.​

6363 3.2may impose sanctions as provided in subdivision 3 and section 609.3455.​
6464 3.3 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to offenders​
6565 3.4placed on intensive supervised release on or after that date.​
