44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. Minnesota Statutes 2024, section 121A.53, is amended to read:​
66 1.6 121A.53 REPORT TO COMMISSIONER OF EDUCATION.​
77 1.7 Subdivision 1.Exclusions and expulsions; student withdrawals; physical​
88 1.8assaults.Consistent with subdivision 2, the school board must report through the department​
99 1.9electronic reporting system each exclusion or expulsion, each fight involving pupils that is​
1010 1.10witnessed by a district employee, each physical assault of a district employee by a pupil,​
1111 1.11and each pupil withdrawal agreement within 30 days of the effective date of the dismissal​
1212 1.12action, pupil withdrawal, or assault, to the commissioner of education. This report must​
1313 1.13include a statement of nonexclusionary disciplinary practices, or other sanction, intervention,​
1414 1.14or resolution in response to the assault given the pupil and the reason for, the effective date,​
1515 1.15and the duration of the exclusion or expulsion or other sanction, intervention, or resolution.​
1616 1.16The report must also include the pupil's age, grade, gender, race, and special education​
1717 1.17status.​
1818 1.18 Subd. 2.Report.(a) The school board must include state student identification numbers​
1919 1.19of affected pupils on all dismissal and other disciplinary reports required by the department.​
2020 1.20The department must report annually to the commissioner summary data on the number of​
2121 1.21dismissals, fights involving pupils witnessed by a district employee, and physical assaults​
2222 1.22of district employees by a student by age, grade, gender, race, and special education status​

3838 2.7witnesses fighting between pupils must report the incident to the building administrator​
3939 2.8responsible for discipline and must file a police report. The school board must report the​
4040 2.9incident to the department according to this section and verify that a police report was filed​
4141 2.10by the district employee who witnessed the fight.​
