55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 171.12, subdivision 11, is amended to read:​
77 1.7 Subd. 11.Certain data on noncompliant license or identification card; department​
88 1.8and agents.(a) For purposes of this section, "immigration status data" means data on​
99 1.9individuals who have applied for or been issued a noncompliant driver's license or​
1010 1.10identification card and that indicate or otherwise have the effect of identifying (1) whether​
1111 1.11the individual has demonstrated United States citizenship, or (2) whether the individual has​
1212 1.12demonstrated lawful presence in the United States. Immigration status data include but are​
1313 1.13not limited to any documents specified under section 171.062; immigration status data​
1414 1.14contained in those documents; or the applicant's submission of the documents.​
1515 1.15 (b) Immigration status data are classified as private data on individuals, as defined in​
1616 1.16section 13.02, subdivision 12. Notwithstanding any law to the contrary, the commissioner​
1717 1.17or a driver's license agent must not share or disseminate immigration status data except to​
1818 1.18or within the division of the department that administers driver licensing and to the secretary​
1919 1.19of state for purposes of improving the accuracy of voter registration records under subdivision​
2020 1.207a.​
2121 1.21 (c) As authorized or required by state or federal law, the commissioner or a driver's​
2222 1.22license agent may share or disseminate data on individuals who have applied for or been​
2323 1.23issued a noncompliant driver's license or identification card that are not immigration status​

3737 2.6 (d) Notwithstanding any law to the contrary, the commissioner or a driver's license agent​
3838 2.7must not share or disseminate any data on individuals who have applied for or been issued​
3939 2.8a noncompliant driver's license or identification card to any federal government entity that​
4040 2.9primarily enforces immigration law, except pursuant to a valid search warrant or court order​
4141 2.10issued by a state or federal judge.​
4242 2.11 (e) Notwithstanding paragraphs (a) to (d), the commissioner must share or disseminate​
4343 2.12to the appropriate state or federal law enforcement agencies immigration status data on​
4444 2.13individuals who have applied for or been issued a noncompliant driver's license or​
4545 2.14identification card if it is determined that the applicant has been convicted of a crime.​
4646 2.15 (f) Violation of this subdivision by the commissioner, a driver's license agent, a​
4747 2.16government entity, or an employee or agent thereof constitutes a violation of the Minnesota​
4848 2.17Government Data Practices Act and may be subject to penalties and remedies applicable​
4949 2.18under that chapter.​
5050 2.19 Sec. 2. APPROPRIATIONS.​
5151 2.20 (a) $218,000 in fiscal year 2026 and $202,000 in fiscal year 2027 are appropriated from​
5252 2.21the general fund to the commissioner of public safety for additional staffing, in consultation​
5353 2.22with the secretary of state, to monitor and audit the records of applicants for noncompliant​
5454 2.23drivers' licenses or identification cards who have not demonstrated citizenship and ensure​
5555 2.24that the applicants have not registered to vote or voted.​
5656 2.25 (b) $218,000 in fiscal year 2026 and $202,000 in fiscal year 2027 are appropriated from​
5757 2.26the general fund to the commissioner of public safety for additional staffing to determine​
5858 2.27if applicants for noncompliant drivers' licenses or identification cards who have not​
5959 2.28demonstrated lawful presence have been convicted of a crime. The commissioner must​
6060 2.29provide information on these applicants to the appropriate law enforcement agency.​
