| 5 | 5 | | 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

| 6 | 6 | | 1.6 Section 1. Minnesota Statutes 2024, section 169.89, subdivision 1, is amended to read: |

| 7 | 7 | | 1.7 Subdivision 1.Violation; when petty misdemeanor enhanced to misdemeanor.(a) |
|---|
| 8 | 8 | | 1.8Unless otherwise declared in this chapter with respect to particular offenses, it is a petty |
|---|
| 9 | 9 | | 1.9misdemeanor for any person to do any act forbidden or fail to perform any act required by |
|---|
| 10 | 10 | | 1.10this chapter; except that: |
|---|
| 11 | 11 | | 1.11 (1) a violation which is committed in a manner or under circumstances so as to endanger |
|---|
| 12 | 12 | | 1.12or be likely to endanger any person or property; or |
|---|
| 13 | 13 | | 1.13 (2) exclusive of violations relating to the standing or parking of an unattended vehicle, |
|---|
| 14 | 14 | | 1.14a violation of any of the provisions of this chapter, classified therein as a petty misdemeanor, |
|---|
| 15 | 15 | | 1.15when preceded by two or more petty misdemeanor convictions within the immediate |
|---|
| 16 | 16 | | 1.16preceding 12-month period; |
|---|
| 17 | 17 | | 1.17is a misdemeanor to which the provisions of subdivision 2 shall not apply. |
|---|
| 18 | 18 | | 1.18 (b) Notwithstanding any law to the contrary, the Judicial Council may not place a |
|---|
| 19 | 19 | | 1.19violation described in paragraph (a), clause (1), on the uniform fine schedule. A violation |
|---|
| 20 | 20 | | 1.20under paragraph (a), clause (1), requires a court appearance. |
