55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 169.89, subdivision 1, is amended to read:​
77 1.7 Subdivision 1.Violation; when petty misdemeanor enhanced to misdemeanor.(a)​
88 1.8Unless otherwise declared in this chapter with respect to particular offenses, it is a petty​
99 1.9misdemeanor for any person to do any act forbidden or fail to perform any act required by​
1010 1.10this chapter; except that:​
1111 1.11 (1) a violation which is committed in a manner or under circumstances so as to endanger​
1212 1.12or be likely to endanger any person or property; or​
1313 1.13 (2) exclusive of violations relating to the standing or parking of an unattended vehicle,​
1414 1.14a violation of any of the provisions of this chapter, classified therein as a petty misdemeanor,​
1515 1.15when preceded by two or more petty misdemeanor convictions within the immediate​
1616 1.16preceding 12-month period;​
1717 1.17is a misdemeanor to which the provisions of subdivision 2 shall not apply.​
1818 1.18 (b) Notwithstanding any law to the contrary, the Judicial Council may not place a​
1919 1.19violation described in paragraph (a), clause (1), on the uniform fine schedule. A violation​
2020 1.20under paragraph (a), clause (1), requires a court appearance.​
