44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. Minnesota Statutes 2024, section 256D.01, subdivision 1b, is amended to read:​
66 1.6 Subd. 1b.Rules; standard of assistance.The commissioner shall adopt rules to set​
77 1.7standards of assistance and methods of calculating payment to conform with subdivision​
88 1.81a. When a recipient is a resident of a licensed residential facility, except shelters for the​
99 1.9homeless or shelters under section 611A.31, the recipient is not eligible for a full general​
1010 1.10assistance standard. The state standard of assistance for those recipients who reside in a​
1111 1.11licensed residential facility and have personal needs not otherwise provided for is:​
1212 1.12 (1) 70 percent of the general assistance standard for recipients receiving housing​
1313 1.13assistance under chapter 256I and residing in a licensed residential facility under section​
1414 1.14256I.04, subdivision 2a, paragraph (a), clause (1) or (2); or​
1515 1.15 (2) the personal needs allowance authorized for medical assistance recipients under​
1616 1.16section 256B.35 for recipients residing in other licensed residential facilities.​
