4 | 4 | | 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

5 | 5 | | 1.5 Section 1. Minnesota Statutes 2024, section 169.13, subdivision 1, is amended to read: |
---|
6 | 6 | | 1.6 Subdivision 1.Reckless driving.(a) A person who drives a motor vehicle or light rail |
---|
7 | 7 | | 1.7transit vehicle while aware of and consciously disregarding a substantial and unjustifiable |
---|
8 | 8 | | 1.8risk that the driving may result in harm to another or another's property is guilty of reckless |
---|
9 | 9 | | 1.9driving. The risk must be of such a nature and degree that disregard of it constitutes a |
---|
10 | 10 | | 1.10significant deviation from the standard of conduct that a reasonable person would observe |
---|
11 | 11 | | 1.11in the situation. |
---|
12 | 12 | | 1.12 (b) A person shall not race any vehicle upon any street or highway of this state. Any |
---|
13 | 13 | | 1.13person who willfully compares or contests relative speeds by operating one or more vehicles |
---|
14 | 14 | | 1.14is guilty of racing, which constitutes reckless driving, whether or not the speed contested |
---|
15 | 15 | | 1.15or compared is in excess of the maximum speed prescribed by law. |
---|
16 | 16 | | 1.16 (c) A person who violates paragraph (a) or (b) is guilty of a misdemeanor. A person who |
---|
17 | 17 | | 1.17violates paragraph (a) or (b) and causes great bodily harm or death to another is guilty of a |
---|
18 | 18 | | 1.18gross misdemeanor. In addition to any other penalty imposed, a person who violates |
---|
19 | 19 | | 1.19paragraph (b) must be fined: (1) not less than $300; (2) not less than $550 for a violation |
---|
20 | 20 | | 1.20occurring within ten years of a prior violation; or (3) not less than $850 for a violation |
---|
21 | 21 | | 1.21occurring within ten years of two or more prior violations. |
