1.1 A bill for an act 1.2 relating to public safety; increasing the criminal penalty for assaulting a firefighter, 1.3 EMS personnel, or certain health care providers; amending Minnesota Statutes 1.4 2024, section 609.2231, subdivision 2. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 609.2231, subdivision 2, is amended to read: 1.7 Subd. 2.Firefighters and emergency medical personnel.(a) Except as provided in 1.8paragraph (b), whoever physically assaults any of the following persons and inflicts 1.9demonstrable bodily harm is guilty of a felony and may be sentenced to imprisonment for 1.10not more than two years or to payment of a fine of not more than $4,000, or both gross 1.11misdemeanor: 1.12 (1) either: 1.13 (i) a member of a municipal or volunteer fire department in the performance of the 1.14member's duties; or 1.15 (ii) a member of an emergency medical services personnel unit in the performance of 1.16the member's duties; or 1.17 (2) a physician, nurse, or other person providing health care services in a hospital 1.18emergency department. 1.19 (b) Whoever physically assaults a person described in paragraph (a), clause (1) or (2), 1.20is guilty of a felony and may be sentenced to imprisonment for not more than three years 1.21or to payment of a fine of not more than $6,000, or both, if the assault inflicts demonstrable 1.22bodily harm. 1Section 1. 25-02622 as introduced01/23/25 REVISOR KLL/EN SENATE STATE OF MINNESOTA S.F.
