55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 244.44, is amended to read:​
77 1.7 244.44 APPLYING EARNED INCENTIVE RELEASE CREDIT.​
88 1.8 Earned incentive release credits are included in calculating the term of imprisonment​
99 1.9but are not added to the person's supervised release term, the total length of which remains​
1010 1.10unchanged. The maximum amount of earned incentive release credit that can be earned and​
1111 1.11subtracted from the term of imprisonment is 17 percent of the total executed sentence.​
1212 1.12Earned credit cannot reduce the term of imprisonment to less than one-half of the incarcerated​
1313 1.13person's executed sentence. Once earned, Earned incentive release credits are nonrevocable​
1414 1.14revocable if the person violates rules of the facility where the person is incarcerated or​
1515 1.15otherwise commits a criminal act while incarcerated.​
