7-1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
8-1.8 Section 1. [325F.998] SKIN-LIGHTENER NOTICE REQUIRED.​
9-1.9 Subdivision 1.Notice required.After August 1, 2026, the commissioner of the Pollution​
10-1.10Control Agency must send a notice to retailers who sell skin-lightening products which​
11-1.11states that selling skin-lightening products that contain mercury is illegal and subject to​
12-1.12penalties.​
13-1.13 Subd. 2.Certification.Businesses who receive notice from the commissioner must​
14-1.14self-certify on a form prescribed by the commissioner that they have received the notice​
15-1.15and will comply with the law.​
16-1.16 Subd. 3.Penalties.Businesses who fail to self-certify may be subject to a fine not to​
17-1.17exceed $........​

5+1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
6+1.6 Section 1. [325F.998] SKIN-LIGHTENER SIGNAGE REQUIRED.​
7+1.7 Subdivision 1.Signage required.After August 1, 2026, at each location where​
8+1.8skin-lightening products are sold at retail, the retailer must display a sign in plain view to​
9+1.9provide public notice that selling skin-lightening products that contain mercury is illegal​
10+1.10and subject to penalties, and that using skin-lightening products that contain mercury may​
11+1.11result in adverse health consequences. The notice must be placed in a conspicuous location​
12+1.12in the retail establishment and must be readily visible to any person who is purchasing or​
13+1.13attempting to purchase skin-lightening products.​
14+1.14 Subd. 2.Signage development.The commissioner of the Pollution Control Agency and​
15+1.15the commissioner of health, in consultation with community-based organizations that have​
16+1.16worked to raise awareness about mercury in skin-lightening products, must jointly develop​
17+1.17the signage required by subdivision 1. Words on the signage must be displayed in at least​
18+1.18the English, Spanish, Hmong, Somali, French, Ethiopian, and Oromo languages.​
