1.3 unfunded mandates; proposing coding for new law in Minnesota Statutes, chapters
1.4 373; 471.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [373.52] NO MANDATES WITHOUT FUNDING.
1.7 Subdivision 1.County noncompliance allowed.(a) Except as provided under subdivision
1.82, a county is not required to comply with a state mandate in paragraph (b) until a state law
1.9provides a county with the amount of revenue needed to pay for the mandate.
1.10 (b) A state mandate that a county is not required to comply with under paragraph (a) is
1.11a mandate that:
1.12 (1) affects the daily operation of a county government;
1.13 (2) changes the allocation of a county's resources; or
1.14 (3) changes a county's spending priorities.
1.15 Subd. 2.Exceptions.A county must comply with a state mandate if the amount of
1.16revenue needed for compliance is incidental compared to the county's total budget. A county
1.17must continue compliance with any law that governs financial audit requirements or that
1.18directly affects the safety and health of county residents.
1.19 EFFECTIVE DATE.This section applies to state mandates that are in effect after June
1.2030, 2025.
