1.1 A bill for an act 1.2 relating to public health; exempting certain hot tubs from public pool regulations; 1.3 amending Minnesota Statutes 2024, section 144.1222, subdivision 2d. 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.5 Section 1. Minnesota Statutes 2024, section 144.1222, subdivision 2d, is amended to read: 1.6 Subd. 2d.Hot tubs on rental houseboats property.(a) A hot water pool intended for 1.7seated recreational use, including a hot tub or whirlpool, that is located on a houseboat 1.8property that is rented to the public is not a public pool and is exempt from the requirements 1.9for public pools under this section and Minnesota Rules, chapter 4717. 1.10 (b) A hot water pool intended for seated recreational use, including a hot tub or whirlpool, 1.11that is located on the property of a stand-alone single-unit rental property that is rented by 1.12the property owner or through a resort, and that is only intended to be used by the occupants 1.13of the rental property, is not a public pool and is exempt from the requirements for public 1.14pools under this section and Minnesota Rules, chapter 4717. 1.15 (c) A hot water pool under this subdivision must be conspicuously posted with the 1.16following notice to renters: 1.17 "NOTICE 1.18 This spa is exempt from state and local sanitary requirements that prevent disease 1.19transmission. 1.20 USE AT YOUR OWN RISK 1.21 This notice is required under Minnesota Statutes, section 144.1222, subdivision 2d." 1Section 1. 25-02168 as introduced01/22/25 REVISOR SGS/EN SENATE STATE OF MINNESOTA S.F.
