35 | 35 | | 2.5part of the decision-making process. This definition adds to statutorily mandated notification |

36 | 36 | | 2.6procedures. During a consultation, the burden is on the agency to show that it has made a |

37 | 37 | | 2.7good faith effort to elicit feedback. Consultation is a formal engagement between agency |
---|
38 | 38 | | 2.8officials and the governing body or bodies of an individual Minnesota Tribal government |
---|
39 | 39 | | 2.9that the agency or an individual Tribal government may initiate. Formal meetings or |
---|
40 | 40 | | 2.10communication between top agency officials and the governing body of a Minnesota Tribal |
---|
41 | 41 | | 2.11government is a necessary element of consultation; |
---|
42 | 42 | | 2.12 (3) "matters that have Tribal implications" means rules, legislative proposals, policy |
---|
43 | 43 | | 2.13statements, or other actions that have substantial direct effects on one or more Minnesota |
---|
44 | 44 | | 2.14Tribal governments, or on the distribution of power and responsibilities between the state |
---|
45 | 45 | | 2.15and Minnesota Tribal governments; |
---|
46 | 46 | | 2.16 (4) "Minnesota Tribal governments" means the federally recognized Indian Tribes located |
---|
47 | 47 | | 2.17in Minnesota including: Bois Forte Band; Fond Du Lac Band; Grand Portage Band; Leech |
---|
48 | 48 | | 2.18Lake Band; Mille Lacs Band; White Earth Band; Red Lake Nation; Lower Sioux Indian |
---|
49 | 49 | | 2.19Community; Prairie Island Indian Community; Shakopee Mdewakanton Sioux Community; |
---|
50 | 50 | | 2.20and Upper Sioux Community; and |
---|
51 | 51 | | 2.21 (5) "timely and meaningful" means done or occurring at a favorable or useful time that |

52 | 52 | | 2.22allows the result of consultation to be included in the agency's decision-making process for |
