77 1.7 Section 1. [325M.335] MENTAL HEALTH WARNING LABEL; POP-UP TIMER​
88 1.8REQUIRED.​
99 1.9 Subdivision 1.Warning label required.(a) A social media platform must ensure that​
1010 1.10a conspicuous mental health warning label that complies with the requirements under this​
1111 1.11section:​
1212 1.12 (1) appears each time a user accesses the social media platform; and​
1313 1.13 (2) only disappears when the user: (i) exits the social media platform; or (ii) acknowledges​
1414 1.14the potential for harm and chooses to proceed to the social media platform despite the risk.​
1515 1.15 (b) A mental health warning label under this section must:​
1616 1.16 (1) in a manner that conforms with the guidelines established under subdivision 2, warn​
1717 1.17the user of potential negative mental health impacts of accessing the social media platform;​
1818 1.18and​
1919 1.19 (2) provide the user access to resources to address the potential negative mental health​
2020 1.20impacts described in clause (1) and include the website and telephone number of a national​
2121 1.21suicide prevention and mental health crisis hotline system, including but not limited to the​
2222 1.22988 Suicide and Crisis Lifeline.​

3131 Referred to Commerce and Consumer Protection​ 2.1 (c) A social media platform is prohibited from:​
3232 2.2 (1) providing the warning label exclusively in the social media platform's terms and​
3333 2.3conditions;​
3434 2.4 (2) including extraneous information in the warning label that obscures the visibility or​
3535 2.5prominence of the warning label; or​
3636 2.6 (3) allowing a user to disable a warning label, except as provided under paragraph (a).​
3737 2.7 Subd. 2.Content of label.(a) The commissioner of health, in consultation with the​
3838 2.8commissioner of commerce, must develop guidelines for social media platforms that contain​
3939 2.9appropriate requirements for the warning labels required under this section. The guidelines​
4040 2.10must be based on current evidence regarding the negative mental health impacts of social​
4141 2.11media platforms. The commissioners must review and revise the guidelines as appropriate.​
4242 2.12 (b) The commissioner of health is exempt from chapter 14, including section 14.386,​
4343 2.13when implementing this subdivision.​
4444 2.14 Subd. 3.Pop-up timer required.(a) Except as provided under paragraph (b), a social​
4545 2.15media platform must display a conspicuous pop-up notification at least once every 30​
4646 2.16minutes that a user has actively used the platform. The notification must:​
4747 2.17 (1) inform the user that the user has actively used the platform for the relevant consecutive​
4848 2.18period of time;​
4949 2.19 (2) inform the user of the total time the user has actively used the platform that day; and​
5050 2.20 (3) only disappear when the user acknowledges the notification.​
5151 2.21 (b) A social media platform may allow a user to:​
5252 2.22 (1) deactivate the notification required under paragraph (a); or​
5353 2.23 (2) customize the period of time resulting in the notification, provided that the maximum​
5454 2.24time period does not exceed 60 minutes.​
5555 2.25 EFFECTIVE DATE.This section is effective July 1, 2025.​
5656 2.26 Sec. 2. Minnesota Statutes 2024, section 325M.34, is amended to read:​
5757 2.27 325M.34 ENFORCEMENT AUTHORITY.​
5858 2.28 (a) The attorney general may investigate and bring an action against a social media​
5959 2.29platform for an alleged violation of section 325M.33 or 325M.335.​
