1.1 A bill for an act 1.2 relating to drivers' licenses; providing an applicant for a driver's license or 1.3 identification card may declare citizenship or immigration status; requiring markings 1.4 on certain drivers' licenses and identification cards; amending Minnesota Statutes 1.5 2024, sections 171.06, subdivision 8; 171.07, subdivisions 1, 3; proposing coding 1.6 for new law in Minnesota Statutes, chapter 171. 1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. [171.025] LIMITATIONS ON USE. 1.9 Notwithstanding any other law to the contrary, a noncompliant driver's license or 1.10identification card marked as provided in section 171.07, subdivision 1, paragraph (g), or 1.113, paragraph (g), is not valid identification for purposes of any services or form of benefit 1.12under Minnesota Statutes. 1.13 Sec. 2. Minnesota Statutes 2024, section 171.06, subdivision 8, is amended to read: 1.14 Subd. 8.Noncompliant license or identification card; residence, lawful status.(a) 1.15A person who applies for a noncompliant driver's license or identification card: 1.16 (1) must declare the applicant's residence address in Minnesota; and 1.17 (2) is not required may choose to demonstrate United States citizenship or lawful presence 1.18in the United States. 1.19 (b) Minnesota Rules, part 7410.0410, or any successor rule, does not apply for a 1.20noncompliant driver's license or identification card. 1Sec. 2. 25-00687 as introduced11/26/24 REVISOR KRB/MI SENATE STATE OF MINNESOTA S.F. Minnesota Statutes 2024, section 171.07, subdivision 1, is amended to read: 2.5 Subdivision 1.License; contents and design.(a) Upon the payment of the required fee, 2.6the department shall issue to every qualifying applicant a license designating the type or 2.7class of vehicles the applicant is authorized to drive as applied for. This license must bear: 2.8(1) a distinguishing number assigned to the licensee; (2) the licensee's full name and date 2.9of birth; (3) either (i) the licensee's residence address, or (ii) the designated address under 2.10section 5B.05; (4) a description of the licensee in a manner as the commissioner deems 2.11necessary; (5) the usual signature of the licensee; and (6) designations and markings as 2.12provided in this section. No license is valid unless it bears the usual signature of the licensee. 2.13Every license must bear a colored photograph or an electronically produced image of the 2.14licensee. 2.15 (b) If the United States Postal Service will not deliver mail to the applicant's residence 2.16address as listed on the license, then the applicant shall provide verification from the United 2.17States Postal Service that mail will not be delivered to the applicant's residence address and 2.18that mail will be delivered to a specified alternate mailing address. When an applicant 2.19provides an alternate mailing address under this subdivision, the commissioner shall use 2.20the alternate mailing address in lieu of the applicant's residence address for all notices and 2.21mailings to the applicant. 2.22 (c) Every license issued to an applicant under the age of 21 must be of a distinguishing 2.23color and plainly marked "Under-21." 2.24 (d) A license issued to an applicant age 65 or over must be plainly marked "senior" if 2.25requested by the applicant. 2.26 (e) Except for a noncompliant license, a license must bear a distinguishing indicator for 2.27compliance with requirements of the REAL ID Act. 2.28 (f) A noncompliant license must: 2.29 (1) be marked "not for federal identification" on the face and in the machine-readable 2.30portion; 2.31 (2) have a unique design or color indicator for purposes of the REAL ID Act; and 2Sec. 3. 25-00687 as introduced11/26/24 REVISOR KRB/MI 3.1 (3) bear no indicator or design that relates to the lawful presence or the citizenship of 3.2the license holder. 3.3 (g) A noncompliant license must be marked "not for voting" on the front side and "not 3.4for benefits" on the back side commensurate with other text if the license is issued under 3.5any of the following circumstances: 3.6 (1) the application is for a first-time issuance of a license in Minnesota and the applicant 3.7has not demonstrated United States citizenship; 3.8 (2) the applicant's most recently issued noncompliant license or identification card is 3.9marked as required under this paragraph or subdivision 3, paragraph (g), and the applicant 3.10has not demonstrated United States citizenship; or 3.11 (3) the applicant submits a document that identifies a temporary lawful status or admission 3.12period. 3.13 (g) (h) A REAL ID compliant license issued to a person with temporary lawful status 3.14or admission period must be marked "temporary" on the face and in the machine-readable 3.15portion. 3.16 (h) (i) A license must display the licensee's full name or no fewer than 39 characters of 3.17the name. Any necessary truncation must begin with the last character of the middle name 3.18and proceed through the second letter of the middle name, followed by the last character of 3.19the first name and proceeding through the second letter of the first name. 3.20 Sec. 4. Minnesota Statutes 2024, section 171.07, subdivision 3, is amended to read: 3.21 Subd. 3.Identification card; content and design; fee.(a) Upon payment of the required 3.22fee, the department shall issue to every qualifying applicant a Minnesota identification card. 3.23The department may not issue a Minnesota identification card to an individual who has a 3.24driver's license, other than a limited license. The department may not issue an enhanced 3.25identification card to an individual who is under 16 years of age, not a resident of this state, 3.26or not a citizen of the United States of America. The card must bear: (1) a distinguishing 3.27number assigned to the applicant; (2) a colored photograph or an electronically produced 3.28image of the applicant; (3) the applicant's full name and date of birth; (4) either (i) the 3.29licensee's residence address, or (ii) the designated address under section 5B.05; (5) a 3.30description of the applicant in the manner as the commissioner deems necessary; (6) the 3.31usual signature of the applicant; and (7) designations and markings provided under this 3.32section. 3Sec. 4. 25-00687 as introduced11/26/24 REVISOR KRB/MI 4.1 (b) If the United States Postal Service will not deliver mail to the applicant's residence 4.2address as listed on the Minnesota identification card, then the applicant shall provide 4.3verification from the United States Postal Service that mail will not be delivered to the 4.4applicant's residence address and that mail will be delivered to a specified alternate mailing 4.5address. When an applicant provides an alternate mailing address under this subdivision, 4.6the commissioner shall use the alternate mailing address in lieu of the applicant's residence 4.7address for all notices and mailings to the applicant. 4.8 (c) Each identification card issued to an applicant under the age of 21 must be of a 4.9distinguishing color and plainly marked "Under-21." 4.10 (d) Each Minnesota identification card must be plainly marked "Minnesota identification 4.11card - not a driver's license." 4.12 (e) Except for a noncompliant identification card, a Minnesota identification card must 4.13bear a distinguishing indicator for compliance with requirements of the REAL ID Act. 4.14 (f) A noncompliant identification card must: 4.15 (1) be marked "not for federal identification" on the face and in the machine-readable 4.16portion; 4.17 (2) have a unique design or color indicator for purposes of the REAL ID Act; and 4.18 (3) bear no indicator or design that relates to the lawful presence or the citizenship of 4.19the identification card holder. 4.20 (g) A noncompliant identification card must be marked "not for voting" on the front side 4.21and "not for benefits" on the back side commensurate with other text if the license is issued 4.22under any of the following circumstances: 4.23 (1) the application is for first-time issuance of a Minnesota identification card and the 4.24applicant has not demonstrated United States citizenship; 4.25 (2) the applicant's most recently issued noncompliant license or identification card is 4.26marked as required under this paragraph or subdivision 1, paragraph (g), and the applicant 4.27has not demonstrated United States citizenship; or 4.28 (3) the applicant submits a document that identifies a temporary lawful status or admission 4.29period. 4.30 (g) (h) A REAL ID compliant Minnesota identification card issued to a person with 4.31temporary lawful status or admission period must be marked "temporary" on the face and 4.32in the machine-readable portion. 4Sec. 4. 25-00687 as introduced11/26/24 REVISOR KRB/MI 5.1 (h) (i) A Minnesota identification card must display the cardholder's full name or no 5.2fewer than 39 characters of the name.
