7	7	1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
8	8	1.8 Section 1. [171.025] LIMITATIONS ON USE.
9	9	1.9 Notwithstanding any other law to the contrary, a noncompliant driver's license or
10	10	1.10identification card marked as provided in section 171.07, subdivision 1, paragraph (g), or
11	11	1.113, paragraph (g), is not valid identification for purposes of any services or form of benefit
12	12	1.12under Minnesota Statutes.
13	13	1.13 Sec. 2. Minnesota Statutes 2024, section 171.06, subdivision 8, is amended to read:
14	14	1.14 Subd. 8.Noncompliant license or identification card; residence, lawful status.(a)
15	15	1.15A person who applies for a noncompliant driver's license or identification card:
16	16	1.16 (1) must declare the applicant's residence address in Minnesota; and
17	17	1.17 (2) is not required may choose to demonstrate United States citizenship or lawful presence
18	18	1.18in the United States.
19	19	1.19 (b) Minnesota Rules, part 7410.0410, or any successor rule, does not apply for a
20	20	1.20noncompliant driver's license or identification card.

29	29	Referred to Transportation 2.1 (c) Nothing in this section allows the commissioner to issue a commercial driver's license
30	30	2.2to an applicant who does not demonstrate proof of citizenship or immigration status if
31	31	2.3required by federal law.
32	32	2.4 Sec. 3. Minnesota Statutes 2024, section 171.07, subdivision 1, is amended to read:
33	33	2.5 Subdivision 1.License; contents and design.(a) Upon the payment of the required fee,
34	34	2.6the department shall issue to every qualifying applicant a license designating the type or
35	35	2.7class of vehicles the applicant is authorized to drive as applied for. This license must bear:
36	36	2.8(1) a distinguishing number assigned to the licensee; (2) the licensee's full name and date
37	37	2.9of birth; (3) either (i) the licensee's residence address, or (ii) the designated address under
38	38	2.10section 5B.05; (4) a description of the licensee in a manner as the commissioner deems
39	39	2.11necessary; (5) the usual signature of the licensee; and (6) designations and markings as
40	40	2.12provided in this section. No license is valid unless it bears the usual signature of the licensee.
41	41	2.13Every license must bear a colored photograph or an electronically produced image of the
42	42	2.14licensee.
43	43	2.15 (b) If the United States Postal Service will not deliver mail to the applicant's residence
44	44	2.16address as listed on the license, then the applicant shall provide verification from the United
45	45	2.17States Postal Service that mail will not be delivered to the applicant's residence address and
46	46	2.18that mail will be delivered to a specified alternate mailing address. When an applicant
47	47	2.19provides an alternate mailing address under this subdivision, the commissioner shall use
48	48	2.20the alternate mailing address in lieu of the applicant's residence address for all notices and
49	49	2.21mailings to the applicant.
50	50	2.22 (c) Every license issued to an applicant under the age of 21 must be of a distinguishing
51	51	2.23color and plainly marked "Under-21."
52	52	2.24 (d) A license issued to an applicant age 65 or over must be plainly marked "senior" if
53	53	2.25requested by the applicant.
54	54	2.26 (e) Except for a noncompliant license, a license must bear a distinguishing indicator for
55	55	2.27compliance with requirements of the REAL ID Act.
56	56	2.28 (f) A noncompliant license must:
57	57	2.29 (1) be marked "not for federal identification" on the face and in the machine-readable
58	58	2.30portion;
59	59	2.31 (2) have a unique design or color indicator for purposes of the REAL ID Act; and
60	60	2Sec. 3.

62	62	3.2the license holder.
63	63	3.3 (g) A noncompliant license must be marked "not for voting" on the front side and "not
64	64	3.4for benefits" on the back side commensurate with other text if the license is issued under
65	65	3.5any of the following circumstances:
66	66	3.6 (1) the application is for a first-time issuance of a license in Minnesota and the applicant
67	67	3.7has not demonstrated United States citizenship;
68	68	3.8 (2) the applicant's most recently issued noncompliant license or identification card is
69	69	3.9marked as required under this paragraph or subdivision 3, paragraph (g), and the applicant
70	70	3.10has not demonstrated United States citizenship; or
71	71	3.11 (3) the applicant submits a document that identifies a temporary lawful status or admission
72	72	3.12period.
73	73	3.13 (g) (h) A REAL ID compliant license issued to a person with temporary lawful status
74	74	3.14or admission period must be marked "temporary" on the face and in the machine-readable
75	75	3.15portion.
76	76	3.16 (h) (i) A license must display the licensee's full name or no fewer than 39 characters of
77	77	3.17the name. Any necessary truncation must begin with the last character of the middle name
78	78	3.18and proceed through the second letter of the middle name, followed by the last character of
79	79	3.19the first name and proceeding through the second letter of the first name.
80	80	3.20 Sec. 4. Minnesota Statutes 2024, section 171.07, subdivision 3, is amended to read:
81	81	3.21 Subd. 3.Identification card; content and design; fee.(a) Upon payment of the required
82	82	3.22fee, the department shall issue to every qualifying applicant a Minnesota identification card.
83	83	3.23The department may not issue a Minnesota identification card to an individual who has a
84	84	3.24driver's license, other than a limited license. The department may not issue an enhanced
85	85	3.25identification card to an individual who is under 16 years of age, not a resident of this state,
86	86	3.26or not a citizen of the United States of America. The card must bear: (1) a distinguishing
87	87	3.27number assigned to the applicant; (2) a colored photograph or an electronically produced
88	88	3.28image of the applicant; (3) the applicant's full name and date of birth; (4) either (i) the
89	89	3.29licensee's residence address, or (ii) the designated address under section 5B.05; (5) a
90	90	3.30description of the applicant in the manner as the commissioner deems necessary; (6) the
91	91	3.31usual signature of the applicant; and (7) designations and markings provided under this
92	92	3.32section.

95	95	4.2address as listed on the Minnesota identification card, then the applicant shall provide
96	96	4.3verification from the United States Postal Service that mail will not be delivered to the
97	97	4.4applicant's residence address and that mail will be delivered to a specified alternate mailing
98	98	4.5address. When an applicant provides an alternate mailing address under this subdivision,
99	99	4.6the commissioner shall use the alternate mailing address in lieu of the applicant's residence
100	100	4.7address for all notices and mailings to the applicant.
101	101	4.8 (c) Each identification card issued to an applicant under the age of 21 must be of a
102	102	4.9distinguishing color and plainly marked "Under-21."
103	103	4.10 (d) Each Minnesota identification card must be plainly marked "Minnesota identification
104	104	4.11card - not a driver's license."
105	105	4.12 (e) Except for a noncompliant identification card, a Minnesota identification card must
106	106	4.13bear a distinguishing indicator for compliance with requirements of the REAL ID Act.
107	107	4.14 (f) A noncompliant identification card must:
108	108	4.15 (1) be marked "not for federal identification" on the face and in the machine-readable
109	109	4.16portion;
110	110	4.17 (2) have a unique design or color indicator for purposes of the REAL ID Act; and
111	111	4.18 (3) bear no indicator or design that relates to the lawful presence or the citizenship of
112	112	4.19the identification card holder.
113	113	4.20 (g) A noncompliant identification card must be marked "not for voting" on the front side
114	114	4.21and "not for benefits" on the back side commensurate with other text if the license is issued
115	115	4.22under any of the following circumstances:
116	116	4.23 (1) the application is for first-time issuance of a Minnesota identification card and the
117	117	4.24applicant has not demonstrated United States citizenship;
118	118	4.25 (2) the applicant's most recently issued noncompliant license or identification card is
119	119	4.26marked as required under this paragraph or subdivision 1, paragraph (g), and the applicant
120	120	4.27has not demonstrated United States citizenship; or
121	121	4.28 (3) the applicant submits a document that identifies a temporary lawful status or admission
122	122	4.29period.
123	123	4.30 (g) (h) A REAL ID compliant Minnesota identification card issued to a person with
124	124	4.31temporary lawful status or admission period must be marked "temporary" on the face and
125	125	4.32in the machine-readable portion.

128	128	5.2fewer than 39 characters of the name. Any necessary truncation must begin with the last
129	129	5.3character of the middle name and proceed through the second letter of the middle name,
130	130	5.4followed by the last character of the first name and proceeding through the second letter of
131	131	5.5the first name.
132	132	5.6 (i) (j) The fee for a Minnesota identification card is 50 cents when issued to a person
133	133	5.7who is developmentally disabled, as defined in section 252A.02, subdivision 2; a physically
134	134	5.8disabled person, as defined in section 169.345, subdivision 2; or, a person with mental
135	135	5.9illness, as described in section 245.462, subdivision 20, paragraph (c).
