55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 462.357, is amended by adding a subdivision​
77 1.7to read:​
88 1.8 Subd. 8a.Emergency shelter facilities.(a) For the purposes of this subdivision,​
99 1.9"emergency shelter facility" means a facility that provides a safe, sanitary, accessible, and​
1010 1.10suitable emergency shelter for individuals, families, or both, experiencing homelessness,​
1111 1.11regardless of whether the facility provides emergency shelter during the day, overnight, or​
1212 1.12both.​
1313 1.13 (b) An emergency shelter facility is a permitted use on any lot zoned for the development​
1414 1.14of multifamily residential housing, commercial uses, or industrial uses.​
1515 1.15 (c) Nothing in this subdivision shall be construed to exclude an emergency shelter facility​
1616 1.16from a lot zoned for uses other than multifamily residential housing, commercial uses, or​
1717 1.17industrial uses, if otherwise permitted by a local zoning regulation.​
