7 | 7 | | 1.7 Subdivision 1.Waiver request.By October 1, 2025, the commissioner of human services, |
---|
8 | 8 | | 1.8in consultation with Tribes, Tribal organizations, and urban Indian organizations, shall apply |
---|
9 | 9 | | 1.9to the Centers for Medicare and Medicaid Services for a waiver to allow the state's medical |
---|
10 | 10 | | 1.10assistance program to provide coverage for traditional health care practices received through |
---|
11 | 11 | | 1.11Indian health service facilities, facilities operated by Tribes or Tribal organizations under |
---|
12 | 12 | | 1.12the Indian Self-Determination and Education Assistance Act, or facilities operated by urban |
---|
13 | 13 | | 1.13Indian organizations under Title V of the Indian Health Care Improvement Act. |
---|
14 | 14 | | 1.14 Subd. 2.Requirements.(a) A qualified provider must determine whether a medical |
---|
15 | 15 | | 1.15assistance enrollee is eligible to receive traditional health care practices under this section. |
---|
16 | 16 | | 1.16 (b) Traditional health care practices are covered under this section if they are received |
---|
17 | 17 | | 1.17from a qualified provider. |
---|
18 | 18 | | 1.18 (c) For purposes of this section, a "qualified provider" is a practitioner or provider who |
---|
19 | 19 | | 1.19is employed by or under contract with the Indian Health Service, a 638 Tribal clinic, or a |
---|
20 | 20 | | 1.20Title V urban Indian organization. Each facility is responsible for ensuring that a qualified |
---|
21 | 21 | | 1.21provider has the necessary experience and appropriate training to provide traditional health |
---|
22 | 22 | | 1.22care practices. |
