4	4	1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
5	5	1.5 Section 1. Minnesota Statutes 2024, section 326.3361, subdivision 1, is amended to read:
6	6	1.6 Subdivision 1.Rules.(a) The board shall, by rule, prescribe the requirements, duration,
7	7	1.7contents, and standards for successful completion of certified training programs for license
8	8	1.8holders, qualified representatives, Minnesota managers, partners, and employees, including:
9	9	1.9 (1) for those individuals who are armed with a firearm, training in the proper use of, and
10	10	1.10the risks and dangers arising from the use of, firearms;
11	11	1.11 (2) for those individuals who are armed with a weapon, training in the proper use of,
12	12	1.12and the risks and dangers arising from the use of, weapons other than firearms, including,
13	13	1.13but not limited to, bludgeons, nightsticks, batons, chemical weapons, and electronic
14	14	1.14incapacitation devices, and restraint or immobilization techniques;
15	15	1.15 (3) for those individuals who are armed with a firearm or armed with a weapon, training
16	16	1.16in first aid and alternatives to the use of force, including advantages to not using force and
17	17	1.17specifically when force should not be used;
18	18	1.18 (4) for those individuals who are armed with a firearm or armed with a weapon, training
19	19	1.19in the legal limitations on the justifiable use of force and deadly force as specified in sections
20	20	1.20609.06 and 609.065;
21	21	1.21 (5) standards for weapons and equipment issued to or carried or used by those individuals;

30	30	Referred to Judiciary and Public Safety 2.1 (6) preassignment or on-the-job training, or its equivalent, required before applicants
31	31	2.2and the applicant's qualified representatives, Minnesota managers, partners, and employees
32	32	2.3may be certified as having completed training; and
33	33	2.4 (7) continuing training for license holders, qualified representatives, Minnesota managers,
34	34	2.5partners, employees, individuals armed with a firearm, and individuals armed with a weapon.
35	35	2.6 (b) The board's rules prescribing preassignment training under paragraph (a), clause (6),
36	36	2.7and continuing training under paragraph (a), clause (7), must address, at a minimum, the
37	37	2.8following:
38	38	2.9 (1) community health and wellness, including drug and alcohol addiction, homelessness,
39	39	2.10and mental illness;
40	40	2.11 (2) first aid, including training in administering cardiopulmonary resuscitation (CPR),
41	41	2.12use of automated external defibrillators (AED), and administering opiate antagonists;
42	42	2.13 (3) conflict and crisis de-escalation strategies and techniques for responding to incidents
43	43	2.14of violence, persons impaired by alcohol or a controlled substance, and persons who are
44	44	2.15suffering from a mental health crisis;
45	45	2.16 (4) orientation to the security industry, including industry standards for reporting incidents
46	46	2.17and preparing written incident reports;
47	47	2.18 (5) orientation to the entities responsible for public safety and the entities' duties and
48	48	2.19roles;
49	49	2.20 (6) the legal and industry standards for how license holders and license holders' agents
50	50	2.21and employees should interact with employees of other entities responsible for ensuring
51	51	2.22public safety;
52	52	2.23 (7) responding to disruptions in building operations, including electrical outages, water
53	53	2.24disruption, water leaks, flooding, elevator service disruptions, and elevator entrapments;
54	54	2.25and
55	55	2.26 (8) identifying internal and external threats to buildings and the buildings' occupants.
56	56	2.27 (c) The board must establish an implementation plan for existing license holders to
57	57	2.28comply with the additional continuing training requirements provided under this subdivision.
58	58	2.29 EFFECTIVE DATE.This section is effective January 1, 2026.
59	59	2.30 Sec. 2. Minnesota Statutes 2024, section 326.3361, subdivision 2, is amended to read:
60	60	2.31 Subd. 2.Required contents.The rules adopted by the board must require:

63	63	3.2of employment, or evidence that the employee has successfully completed equivalent training
64	64	3.3before the start of employment. Notwithstanding any statute or rule to the contrary, this
65	65	3.4clause is satisfied if the employee provides a prospective employer with a certificate or a
66	66	3.5copy of a certificate demonstrating that the employee successfully completed this training
67	67	3.6prior to employment with a different Minnesota licensee and completed this training within
68	68	3.7three previous calendar years, or successfully completed this training with a Minnesota
69	69	3.8licensee while previously employed with a Minnesota licensee. The certificate or a copy of
70	70	3.9the certificate is the property of the employee who completed the training, regardless of
71	71	3.10who paid for the training or how training was provided. Upon a current or former employee's
72	72	3.11request, a current or former licensed employer must provide a copy of a certificate
73	73	3.12demonstrating the employee's successful completion of training to the current or former
74	74	3.13employee. The current or former licensed employer must not charge the employee a fee for
75	75	3.14a copy of the certificate. The employee who completed the training is entitled to access a
76	76	3.15copy of the certificate at no charge according to sections 181.960 to 181.966. A current or
77	77	3.16former employer must comply with sections 181.960 to 181.966;
78	78	3.17 (2) certification by the board of completion of certified training for a license holder,
79	79	3.18qualified representative, Minnesota manager, partner, and employee to carry or use a firearm,
80	80	3.19a weapon other than a firearm, or an immobilizing or restraint technique; and
81	81	3.20 (3) six 24 hours a year of certified continuing training for all license holders, qualified
82	82	3.21representatives, Minnesota managers, partners, and employees, and an additional six hours
83	83	3.22a year for individuals who are armed with firearms or armed with weapons, which must
84	84	3.23include annual certification of the individual.
85	85	3.24 An individual may not carry or use a weapon while undergoing on-the-job training under
86	86	3.25this subdivision.
87	87	3.26 EFFECTIVE DATE.This section is effective January 1, 2026.
